Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 7,056,000 gallons per day (GPD) of water from on-site quarry sumps for operation of the LeRoy Quarry (Dolomite Products) Facility. The mine and aggregate processing facility has been in operation in recent years and no changes in current operations are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Project Description:

This is a notice for the proposed 5-year treatment permit for maintenance aquatic herbicide treatments in a private 4.9-acre pond with an herbicide to control native aquatic vegetation, namely coontail. The pond is within State Freshwater Wetland HR-4 (Class 2). The herbicide proposed for use is the active ingredient fluridone, trademarked and sold as Sonar One®. The entire pond will be treated as concentrations of this vegetation have been identified as interfering with swimming, fishing, and boating. Treatment will be done once each year during the growing season, and post-treatment monitoring will be done late in the growing season to determine need for subsequent year's treatment. Application will be done by a certified applicator according to label directions.

Project Description:

Keeler Construction Company Inc has applied for renewal and modification of its Air State Facility Permit for the Wilson Quarry, last modified July 27, 2010. The 2010 modification specified methods of emission calculations, and authorized the use of waste oil A as defined in 6 NYCRR Part 225-2.2, as an alternative to number 2 fuel oil, for the 6 ton hot mix asphalt batch plant.

Modifications proposed in the application are limited to equipment replacements, and the addition of natural gas to number 2 fuel oil and waste oil A as a third alternate fuel for the hot mix asphalt plant. Keeler Construction does not propose a change in the existing emission limits for carbon monoxide (CO) and oxides of nitrogen (NOx), each remaining capped at 99.9 tons per year, below the 100 ton per year Part 201-6 (Title V) thresholds. Keeler also remains subject to 40 CFR Part 60 New Source Performance Standards Subpart I for Hot Mix Asphalt Facilities and Subpart OOO for Nonmetallic Mineral Processing Plants.

Emissions from the diesel powered generator units will continue to be calculated based on the hours of operation of each unit and the manufacturer's emission specifications. Hot mix asphalt plant NOx and CO emissions will continue to be calculated based on EPA's AP-42 emission rates of 0.12 pounds NOx and 0.40 pounds CO per ton of hot mix asphalt produced, for batch type asphalt plants using number 2 fuel oil or waste oil A. When natural gas is used as asphalt plant fuel, the applicable AP-42 emission rates for calculations are 0.025 pounds NOx and 0.40 pounds CO per ton of asphalt produced.

In response to the application, the Department has generated a Draft Air State Facility Permit including conditions that continue to restrict facility CO and NOx emissions to below Title V thresholds on a 12 month rolling total basis.

The Draft Permit requires Keeler Construction Company Inc to maintain monthly records of fuel use and resultant emissions on site for a minimum of five years. These records must be made available with all supporting data to Department inspectors upon request.

The Department has made a tentative determination to issue the Draft Permit as a Final Permit if comments received do not raise significant issues that must be addressed before a permit can be issued.
