Project Description:

The Department is accepting public comment on an application to renew a state air facility permit. for the continued construction and operation of the NYC Department of Sanitation (DSNY) East 91st Street Converted Marine Transfer Station (MTS) located on the upper east side of Manhattan, along the East River.

The Air State Facility (6 NYCRR Part 201) is subject to the provisions of State Facility requirements specified under 6 NYCRR 201-7. The facility has potential emissions from exempt combustion sources and trivial activities. This State Facility Permit caps Oxides of Nitrogen emissions to less than 22.5 tons per 12 month rolling period. Records demonstrating compliance with this cap will be kept in accordance with the permit conditions. The draft Air State Facility permit contains a listing of the applicable federal and state compliance monitoring requirements for the facility.

The renewal application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated.

The site is located within Manhattan tax block 1587, lot 27 and part of lot 1, East River, FDR Drive, and 91st Street.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The applicant proposes to replacement of water mains within the Staten Island roadways of Richmond Road from Arthur Kill Road to St. Patrick Place, and along Arthur Kill Road from Richmond Road to Clark Avenue. The project site is located within NYSDEC regulated Class I Freshwater Wetland AR-3 (Richmond Creek) and the public roadways noted above.

Project Description:

The project consists of the construction of one (1) commercial retail building with cellar and associated parking lot. A portion of the building and paved areas are located within the tidal wetland adjacent area. Mitigation for impacts includes a deed restricted Dedicated Area of No Disturbance comprised of a 10'-0" wide restoration planting buffer strip running the width of lot and set back 30'-0" from the rear (north side) of the building and all remaining lands north of the buffer strip and within the property as shown on project drawings. The project site is located at the northwest intersection of Arthur Kill Road and Ellis Street, Block 7987, Lots 1, 5, and 15.
