Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 5.76 Million Gallons Per Day (Million GPD) of water from an on-site pond for operation of the Wingdale Mine Facility. The granite mining and aggregate processing facility has been in operation for decades. No changes in current operations from recent years are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

The applicant is proposing disturbances to NYS Freshwater Wetland HP-23, Class II, and its regulated 100-foot adjacent area, and the Maritje Kill (NYS Water Index #: H-120, Class B) in association with the flood mitigation project to raise the vertical profile of County Route 41 (Crum Elbow Road) to pass stormwater resultant from a 25 year storm event without overtopping the roadway. The safety improvement proposal includes the following work: installation of ground improvement columns; subbase fill to raise the roadway; installation of retaining walls (reduces wetland impacts); removal of existing damaged culverts and installation of two 8' by 15' box culverts to pass Crum Elbow Road over the Maritje Kill; installation of three 36" overflow pipes to assist in passing stormwater flow; and reconstruction of the road and installation of roadway appurtenances. The project is proposed to occur from 200 feet west of Cardinal Road to 200 feet east of Horns Park Road.

Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems (SPDES) permit (NY#0027901) for the surface discharge of 6.0MGD of treated wastewater to the Ramapo River, a class C water. The Orange Co. Sewer District #1 - Harriman Sewage Treatment Plant sends treated sewage through a junction box (outfall 01A) before being discharged through Outfalls 001 and 002. Treatment at the facility consists of three separate treatment trains, which share screening and grit removal. The treatment trains consist of activated sludge clarifiers, aeration basins and secondary clarifiers, sand filters, chlorine contact tank with dechlorination, post aeration oxidation ditches, and primary clarifiers. Effluent from all three trains are combined in Outfall 01A before discharge. Sludge is sent to sludge thickener tanks and sludge dewatering filter belt presses before it is hauled to a disposal facility.

DEC proposes to incorporate the following modifications to this permit: new/revised limits to TDS, ammonia, chlorine, copper and sulfates; new mercury limit and Mercury Minimization Program; new total phenolics action level; new zinc limit; new limits for chlorides, CBOD5 winter limits, summer UOD monitoring and phosphorus monitoring; Short term monitoring of hardness, lead, chloroform, endosulfate I, and bis (2-ethylhexyl) phthalate; new WET testing requirements; new monitoring location at outfall 01A (flow and temperature monitoring still required at outfalls 001 and 002); and updated forms incorporating the latest general conditions.
