Negative Declaration

Bronx County (Bronx) - The New York City Department of Environmental Protection (NYC DEP), as lead agency, has determined that the proposed Westchester Creek Combine Sewer Overflow (CSO) Modifications will not have a significant adverse environmental impact. The action involves a proposal by the NYC DEP to reduce the volume of CSO discharged to Westchester Creek by increasing the capacity of the existing sewers through weir modifications. The proposed project would extend the length of the existing fixed weirs and raise the weir crest elevation by two feet to enable the NYC DEP to fulfill its commitment to reduce the volume of CSO discharged to Westchester Creek and to comply with the New York State Department of Environmental Conservation (NYS DEC) Combined Sewer Overflow Consent Order.

The proposed action would occur at two project sites in non-contiguous areas located in the Bronx. Relief Structure CSO-29 is located in the right-of-way along Eastchester Road, north of Waters Place; and Relief Structure CSO-29A is located primarily in the right-of-way at the intersection of Eastchester Road and Morris Park Avenue.

All construction activities are anticipated to occur over an approximate 33 month period and would vary in duration by relief structure.

The project is located at CSO-29 Eastchester Road, north of Waters Place and CSO-29A at the intersection of Eastchester Road and Morris Park Avenue in the Bronx, New York.
