The project involves the construction of a 3 acre gravel pad to support the installation of a number of capacitor banks. A Stormwater Pollution Prevention Plan has been prepared in accordance with the NYS Standards and Specifications for Erosion and Sediment Control and the NYS Stormwater Management Design Manual. The application, SWPPP and draft permit are available for review upon request.

Project Description:

CSX Transportation, Inc. proposes to construct a second mainline track for approximately 7.8 miles from the Town of Catskill, through Athens, to the Town of Coxsackie, Greene County, NY. The second mainline track would be constructed 15 feet east of the existing mainline track, as measured from track centerline to track centerline for the majority of the route. This second track is to be located where a second track was historically located on pre-existing railbed which will be widened by three feet. CSX also proposes the installation of one new universal crossover, culvert extensions and repairs; replacement of the superstructure of Murderer's Creek bridge, installation/relocation of traffic control points, removal and/or replacement of existing turnouts; construction of two new gravel access roads parallel to the tracks for inspection and maintenance purposes. The project will require three temporary staging area for equipment staging, laydown, material storage and parking during construction. The purpose of this project is to improve efficiency and capacity along the CSX River Line. The project will temporarily impact 31 linear feet and permanently impact 17.5 linear feet of two Class C intermittent streams. The project will result in temporary impacts to 0.76 acres and permanent impacts to 0.61 acres of wetland. Temporarily impacted wetlands will be restored to preconstruction elevation and conditions with replacement of wetland soils and seeding. Wetland mitigation is proposed with the construction of 1.83 acres of wetland on a property located in the Town of Catskill, located 4.7 miles from the CSX project. The property would be put in a conservation easement, to be protected in perpetuity.

Based on the information provided in cultural resources survey reports for this project, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. Measures have been undertaken in consultation with OPRHP to avoid or mitigate impacts to registered or eligible resources. These agreed upon measures conclude the SHPA review.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 6.3648 Million Gallons Per Day (Million GPD) of water from on-site ponds for washing aggregate and dust control at the Howe's Cave Quarry Facility. The limestone excavation facility has been in operation since the early 1870s. No changes in current operations from recent years are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).
