The applicant proposes to disturb 1,177 square feet of NYS Freshwater Wetland BR-39 & 2.4 acres of regulated wetland adjacent area to construct an access road, stormwater management basins & 350 parking spaces on the north side of Independent Way in Brewster, to serve Southeast Train Station. Total disturbance, including uplands, will be 7.7 acres. The project will also create 9,781 square feet of wetland and enhance 0.54 acres of wetland & 2.7 acres of regulated adjacent area by replacing invasive species with native vegetation.

Project Description:

The Department has made a tentative determination to approve this application for a new SPDES permit # NY 021 9339 for YGS Torah Center (location formerly known as Daytop Village), located at 4446-4483 State Route 55 (aka Swan Lake Road), to discharge up to 40,000 gallons per day of treated wastewater to the West Branch of Mongaup River (Water Index # D-10-22; Class B(t)).

The applicant proposes to use the existing treatment system; the previous permit expired in 2010. The permittee will be required to maintain records and report data to verify compliance with the SPDES permit conditions and discharge limits.

The draft SPDES permit with DEC proposed effluent limits and monitoring requirements is available for review at the DEC Region 3 headquarters in New Paltz. The draft permit includes changes from the previous permit to the effluent sampling frequency and type, as well as the effluent monitoring.
