Project activities include: repair of approximately 215 feet of deteriorated steel sheet-pile bulkhead; rehabilitation of three river access areas with 225 cubic yards of fill material below mean high water (MHW); construction of a 720 square feet observation platform on open piles; rehabilitation of existing rock revetment with 250 cubic yards of fill material below MHW; removal and in-kind replacement of 5,200 cubic feet of concrete with 225 cubic yards of below MHW; and the installation of a kayak launch.

Project Description:

The applicants, the Village of Florida, the Town of Chester, and the County of Orange, propose disturbances within state-regulated freshwater wetland WR-14 and its adjacent area, excavation & fill within Glenmere Lake, NYS Waters Index # H-139-13-59-P 668, Class AA), and modification of regulated dam NY179-0460, Glenmere Lake Dam. Rehabilitation of the dam is required under the Decision and Order of the Commissioner, DEC Case No. CO3-20070201-2. Changes to the dam structure, including expansion of the footprint are necessary to bring the dam into compliance with NYSDEC dam safety standards. The lake is habitat for the NYS-listed, endangered species northern cricket frog. The modification of the dam will result in the permanent taking of suitable habitat and temporary impact on essential behaviors and on occupied habitat. A mitigation plan has been developed which includes surveying of vernal pools, spring emergence surveys, summer calling surveys, and fall hibernaculum surveys.

The applicant proposes reconstruction and modification of a platform and excavation & fill in navigable waters for the replacement of a pedestrian walkway over an embayment of the Hudson River at the existing County Park. The former walkway was destroyed by Hurricane Sandy. The new walkway will be expanded from a width of nine feet to a walkway of varying width, a maximum of 14.5 feet at the widest point; a total increase of 372 square-foot of walkway surface area is proposed. Project Description:

The Village of Woodbridge is proposing to repair the partially breached Silver Lake Dam (NYS Dam Inventory #: NY 163-0734) and restore the lake to its pre-breach water level. The project includes the construction of a new concrete spillway, construction of a concrete overlay along the upstream face of the existing rock dam, rehabilitation of the existing low level drain pipes and valves, the construction of a grass-lined emergency earthen spillway and installation of stone rip-rap scour protection. Portions of the bed and banks of Sandburg Creek (NYS Water Index #: H-139-14-38, Class B) are proposed to be disturbed, and excavation within Silver Lake (NYS Water Index #: H-139-14-38-P 807, Class B) is proposed as part of the dam rehabilitation project. The project is located on the west side of Silver Lake Road, approximately 0.15 mile north of the intersection of Silver Lake Road and Mountaindale Road.

The applicant proposes reconstruction of a Class B Hazard dam which was breached in 2006 and which will impound NYS Waters Index # D-10-22-P 128-1, a Class B(t) tributary of Swan Lake. The proposed dam will have the same crest height and normal pool elevation as the previous dam. The redesigned spillway and the auxiliary spillway will be in the same locations. A new low level outlet with plunge pool will be installed and seepage prevention devices will be added. The former stream channels at the outfall and low level outlet will be reestablished.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 2.4336 Million Gallons Per Day (Million GPD) of water from an on-site well fed pond for irrigation of the Centry Country Club Facility. The golf course facility has been in operation since the early 1900s with its current irrigation system from the early 2000s. No changes in current operations from recent years are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).
