Project Description:

The NYSDEC is proposing to undertake a number of maintenance, rehabilitation and modification activities to the existing Avon Marsh Dam facility located at the NYSDEC Region 8 Office in Avon, NY. Phase 1 work would include the clearing of brush, turf reinforcement, installation of 400 lineal feet of supplemental stone wave protection, installation of 300 lineal feet of stone slope protection, installation of outlet protection, culvert rehabilitation/replacement, the construction of a second auxiliary spillway and a 0.7 feet reduction in the permanent pool elevation. Phase II work would include the repair/replacement of the outlet culvert, scour protection and re-grading of the south embankment. The above work will impact approximately 0.44 acres of regulated wetland and 0.55 acre of wetland adjacent area. Mitigative emergent marsh plantings and woody habitat placement will be performed as part of the project.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The Department proposes to re-authorize and modify the SPDES permit for the Village of Penn Yan Water Treatment Plant which discharges treated water treatment plant backwash wastewater to Keuka Lake, a class AA waterbody. The new draft SPDES permit includes a revised limit for total residual chlorine (TRC) of 0.06 mg/l. As a tentative determination, the Department seeks comments prior to making a final decision. The file is available for review and comment at NYSDEC Region 8 Office.

Project Description:

Applicant proposes to extend the sanitary sewer to serve a new condo development. The project includes construction of 8-inch sanitary sewers, two sanitary pump stations, and an access road/trail, with one pump station and a portion of sewer lines and access road to be located within the 100-foot adjacent area (AA) of State Freshwater Wetland PY-1 (Class 1). A gravel access road will be constructed to the pump station from Monell Street. A trail will be constructed to the south, partially located along the abandoned railroad bed to join the proposed walking trail for the condo development. Total disturbance within the 100-foot AA is approximately 600 linear feet for trail access road/sewer line, with no disturbance to the wetland, requiring an Article 24 Freshwater Wetlands permit.
