Project Description:

The Department has prepared a draft permit and made a tentative determination to issue a State Facility Permit renewal for the Swarovski Lighting chandelier manufacturing facility. The renewal contains minor changes reflecting the May 2013 revision of 6 NYCRR Subpart 228-1 (Surface Coating Processes) but is otherwise basically unchanged from the current permit which was last modified in July 2012.

The applicant manufactures chandeliers with a variety of finishes. The chandeliers with highly reflective finishes use coatings which do not meet the volatile organic compound (VOC) content requirements of Subpart 228-1. The applicant has provided documentation that compliant coatings which meet their specific requirements are not available. The current permit includes a waiver to allow the limited use of these coatings and the permit renewal extends that waiver for three more years. The permit also includes facility-wide caps of VOCs and hazardous air pollutants (HAPs) below major source levels.

State Environmental Quality Review (SEQR) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC has made a tentative determination to reauthorize this permit for a standard ten year term maintaining effluent limitations and monitoring and reporting requirements. This permit involves the subsurface discharge of: 11,000 gallons per day via Outfall 001; 1,000 gpd each via Outfalls 002 through 009, 011, 012, 014, 015; and, 4,500 gpd via Outfall 013 of treated sanitary waste. Nearest waterbody: Moreau Lake and tributary-Snook Kill.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a Title V permit renewal for the Commonwealth Plywood Inc. facility at 10068 US Rt 4, Whitehall. This is a Renewal application only, including no modifications to the existing Title V Permit. The applicant has updated their VOC RACT analyses which includes a cost-benefit analysis for EPA consideration.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing.
