Project Description:

The Department has received and made a tentative determination to approve an application for the relocation of stormwater outfall S09 to redirect flow to Franks Creek, downstream of the existing discharge point to prevent further erosion at its current location. This project will include some work in Franks Creek including removal of sediments and debris that have accumulated within the area of the Parshall Flume as well as construction of drainage enhancements that will convey the outfall discharge onto the existing protected concrete mat and into the Parshall Flume structure. As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance. A draft permit is available for review.

The Department has made a tentative determination regarding the proposal by the New York Power Authority (NYPA) to relocate and upgrade their current winter moorings facility located on the First Buffalo River Marina property at 32 Fuhrmann Blvd, Buffalo, NY. The proposed facility will be relocated approximately 1050 feet north of the existing facility. The project area is essential to the NYPA ice boom operations on Lake Erie and will be used from November through April each year. The project area will be used during this time period for the mooring of NYPA vessels that will maintain the ice boom. As a tentative determination, the Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of an activity for which a permit is sought.

The Department has made a tentative determination to approve an application for an existing seasonal (May through September) withdrawal of up to 366,000 gallons per day (GPD) of water from Buffalo Creek for operation of the Elma Meadows Golf Course. The average annual water withdrawal would be 3,546,000 gallons per year (GPY) and the peak annual water withdrawal would be 10,104,000 gallons per year (GPY). The facility has also applied for an Article 15 Protection of Waters permit for the replacement of two withdrawal pipes with one more efficient pipe. The golf course has been in operation since 1958. As a tentative determination, the Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of an activity for which a permit is sought.

Project Description:

The Department has prepared a draft permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments, and made a tentative determination to approve the permit renewal for the existing facility located at 4511 Hyde Park Blvd. The company is a manufacturer of refractory mixtures, dielectric and ceramic powders. Primary products produced are titanium oxide, zirconium silicate, potassium titanate, zirconium oxide, and dielectric powders primarily manufactured from barium titanate. The facility is a major source of nitrogen oxide (NOx) and particulate matter and therefore subject to 40 CFR 70 Title V. Emission factors have been developed from stack testing results and production rates. Particulate matter is subject to the regulatory emission limits of 6NYCRR 212. NOx emissions are in excess of 100 TPY and must comply with Reasonably Available Control Technology (RACT) requirements of 6NYCRR 212-10. A RACT analysis demonstrated there are no control options available, therefore a variance has been approved allowing maximum NOx emissions of 210 tons per year.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
