Project Description:

Establishment of a 2,100 foot long by 10-12 foot wide free flowing channel from an existing 24 inch culvert on the east side of Wheatland Center Road to a defined outlet in the woods to the east. Approximately 480 yards of material will be excavated and spread evenly in a 12 foot area along either side of the newly established channel.

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has received an Air State Facility application from the University of Rochester, for a renewal and modification of its Air State Facility Permit originally issued January 1, 2005, that replaced a Title V Permit issued November 24, 2000, for operations at the University Campus, Hospital Medical Center, and the associated Power Plant. The initial Air State Facility Permit included permit conditions to limit fuel use to restrict facility potentials to emit oxides of nitrogen (NOX) and sulfur dioxide (SO2) to 98 tons per year each. These restricted facility emissions to below 100 ton per year thresholds in 6 NYCRR Part 201-6 (Title V), Part 231‑2 New Source Review in Nonattainment Areas and Ozone Transport Regions, and 40 CFR 52.21 Prevention of Significant Deterioration (PSD).

The Permit was modified March 8, 2006, to correct monitoring requirements to require continuous boiler emission opacity monitoring only when distillate oil is the fuel, and on July 23, 2007, to require vapor control for previously exempt gasoline storage due to increased throughput. Neither modification changed the previously established emission limits for NOX or SO2. Changes proposed in the application from current operations include:

  • Operating the four dual fuel boilers as natural gas fired boilers as defined in 40 CFR Part 63 Subpart JJJJJJ. This involves firing with #2 fuel oil only as a backup during gas supply interruption and for limited periodic testing. This will exempt the boilers from the requirements of 40 CFR Part 63 Subpart JJJJJJ - National Emission Standards for Hazardous Air Pollutants (NESHAP) for Industrial, Commercial, and Institutional Boilers Area Sources.
  • The replacement of a #2 fuel oil fired boiler with a natural gas fired boiler; and
  • The addition of generator engines for emergency power generation.

Facility Emission Units (EU) will include: EU 0‑00002, a multiple chamber incinerator for cremation of animal remains and bedding; EU 0‑00008, a multiple chamber retort incinerator for cremation of human remains; EU T-ANK05, an underground gasoline storage tank with Stage 1 vapor collection system; and EU B‑OILRS, five natural gas fired boilers, including one cogeneration unit providing power as well as steam.

In response to the application, the Department has generated a Draft Modified Air State Facility permit that continues to restrict facility emissions of NOX and SO2 to 98 tons per year each, adds a condition to reflect the exemption from the Subpart JJJJJJ NESHAP, adds a single temporary gas fired boiler, and adds the emergency generator engines.

The Department has made a tentative determination to issue the Draft Permit as a Final Permit if comments received do not raise significant issues that must be addressed before a permit can be issued. Project Description:

The applicant has applied for an initial permit for the continued withdrawal of up to 2.15 Million Gallons Per Day (Million GPD) of water from three spring fed water sources, Main Spring Pond Creek Spring, and Butternt Pond for operation of the Bath Fish Hatchery Facility. The hatchery has been in operation since 1893. No changes in current operations are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume. The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).
