Project Description:

The applicant proposes to remove the Saw Mill Dam on the Boquet River, a Class A low hazard dam (#237-0449). The dam spillway is 205 ft long x 9 ft high and consists of timber cribbing with wood planking on the upstream face. The dam is deteriorating and has no functioning use. The dam also contains a fish ladder on the river right bank used to pass Atlantic salmon upstream, located on DEC state-owned lands. Approximately one-half of this fish ladder is going to be removed, and the other half is proposed to be converted to a ADA-approved viewing platform, with a small parking lot and a dry hydrant installed on state-owned land in the vicinity of the viewing platform. The existing dam is founded on top of a large bedrock falls. A small portion of bedrock may need to be removed to allow fish passage naturally within the primary salmon migration route over the Boquet River Falls. Approx. 1,000 yards of accumulated "clean" sediment will be removed from the impounded area immediately upstream of the dam, and disposed of in an upland area off-site. The sluiceway on the left river bank will remain in place, and filled with sediment. Existing rip rap on river right bank will be moved back even with viewing platform. Total excavation for this project will be approx. 425 cu yds, and placement of fill will be approx. 75 cu yds.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has prepared a draft permit, and has made a tentative determination to issue a modification to the facility's Solid Waste Management Facility permit in an effort to consolidate all prior modifications into a concise document and to format the permit consistent with other landfill permits in the Region. Permit was updated to remove conditions that have been since incorporated into the 6NYCRR Part 360 regulation, incorporate modifications or renewals that we issued via letter in previous years, and reference Department approved operating procedures and plans. There are no changes to the facility being proposed as part of this action, nor are there any changes to applicable requirements intended. The facility is located at 847 Mud Road in the Town of Johnstown, Fulton County.

The City of Glens Falls has applied for a modification of their existing Water Withdrawal permit to authorize the sale of up to 72,000 gallons per day of water from the Butler Pond Watershed Well to the JUST Beverages, LLC water bottling facility to be located in the City of Glens Falls. This includes the construction of the Butler Pond Watershed Well, treatment, storage, and transfer facilities located along Butler Pond Road in the Town of Queensbury, Warren County for the purpose of extracting water and transferring it to the JUST Beverages, LLC bottling facility.
