The applicant proposes to renew and modify a previously permitted 13 acre sand and gravel life-of-mine. The permit modification is for the expansion of the previously permitted affected area from 5 acres to 5.8 acres, the importation of clean, well-composted bovine manure and a revised Reclamation Plan. The final reclamation contours for the mine floor depth will be lowered by 10 feet. The project is located on the west side of County Route 18, approximately .2 miles north of the intersection of Coontown Mountain Road.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 5.328 Million Gallons Per Day (Million GPD) of water from an on-site ponds for operation of the Warren W. Fane Hemstreet Park Pit Facility. The sand and gravel mining facility has been in operation since the 1970s. No changes in current operations from recent years are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Project Description:

The applicant requests a transfer and renewal/re-issuance of the facility State Pollutant Discharge Elimination System (SPDES) Permit to discharge 600 gallons per day of treated sanitary wastewater into surface waters, a ditch discharging to a tributary of Fly Creek, from one septic tank outfall location at the applicant's facility located on U.S. Route 20, Esperance, Schoharie County, New York.

The Department has made a tentative determination to re-issue this SPDES permit under Article 17 of the Environmental Conservation Law maintaining the effluent limitations and monitoring and report requirements as authorized under the previously issued permit. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.
