Project Description:

The Department has prepared a draft permit and made a tentative determination to issue a renewal of the Air State Facility Permit for Jeffords Steel and Engineering. The renewal addresses emissions from metal fabricating and painting processes and incorporates requirements of 40 CFR 63 Subpart XXXXXX (National Emission Standards for Hazardous Air Pollutants: Area Source Standards for Nine Metal Fabrication and Finishing Source Categories). The permit contains conditions which limit emissions of volatile organic compounds (VOCs) and hazardous air pollutants (HAPs) to minor source levels. The renewal does not increase allowable emissions.

State Environmental Quality Review (SEQR) Determination:

Project Description:

The applicant proposes to modify their existing SPDES permit to change the monitoring requirement for a fecal bacteria indicator from Enterococci to Escherichia Coli. The permittee also requested that the landfill stormwater Outfall 020 be relocated to accommodate recent wetland expansion and future landfill development. The existing facility discharges treated surface wastewater to Lake Champlain, a Class B water, located at 568 Shore Airport Rd, Ticonderoga, NY.

The Department has made a tentative determination to issue a State Pollutant Discharge Elimination System (SPDES) permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project. Refer to SPDES #NY-000 4413.

Project is Located:

Project Description:

Proposed mining and processing of consolidated stone (granite gneiss) on 55 acres of a 288 acre site. A 4,300 foot long access road from the new mine to U.S. Route 4 will involve an additional seven acres, resulting in a total affected area of 62 acres. Mining is proposed below the local water table. Material processing will occur within the quarry, as well as occasional blasting. About 226 acres of forest and field around the mine site will remain undisturbed. The reclamation objective is grassland and a pond. The following permits are requested: Mined Land Reclamation - For mining activity described above, with 31 acres to be affected during the coming permit term. Air State Facility (ASF) - The Department has prepared a draft permit and made a tentative determination to issue an ASF permit for the aggregate processing facility. Rock is to be mined at the site and crushed and screened to produce saleable products. Electricity to operate the plant will be produced by diesel generators. The permit limits the generators' hours of operation so that emissions of nitrogen oxides are capped at a minor source level. There are no other pollutants with major source level potential emissions. Stream Disturbance - To construct bridge abutments for the access road in the banks of two streams (class C(T)), tributaries of Wood Creek/Barge Canal. Water Quality Certification - For disturbance to waters of the United States (wetlands, intermittent stream channels): 0.43 acre of direct impacts and 1.19 acres of indirect impacts. The project is located to the west of Route 4, north of Kelsey Pond Road and Goodsell Lane, opposite NYS Route 22 in Comstock.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
