Project Description:

This Department has made a tentative determination to approve an application for renewal of the applicant's Air State Facility (ASF) permit. This ASF permit renewal contains the addition of a federally enforceable greenhouse gas (GHG) emissions limit, established to avoid the requirements of the Prevention of Significant Deterioration (PSD) and Title V Greehouse Gas Tailoring Rule. The combustion sources that contribute to GHG emissions include boilers and emergency generators operated throughout the hospital/research complex. Carbon dioxide equivalent (CO2e) emissions will be calculated monthly on a 12-month rolling total basis, then compared to the facility-wide emission cap of 99,000 tpy CO2e to verify compliance with this limit. This renewal also includes the addition of eleven formerly exempt existing emergency generators with applicable 40CFR63, Subpart ZZZZ requirements and two new emergency generators with applicable 4CFR60, Subpart IIII requirements. The applicant participates in the New York Independent System Operator (NYISO) demand response program for a maximum of 100 hours per year, per generator. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the NYSDEC Office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated.

Project Description:

The applicant proposes to modify their current permit for the mining of sand and gravel and material processing. The modification involves alteration of the existing reclamation plan on the Gentner portion of the Vaughn Deposit. In addition, the excavation depth within this mining area is proposed to be below the groundwater table to a maximum depth of 67.0 feet. The Gentner portion of the mine is approximately 50 acres in size and the current reclamation objective is agricultural. The proposed modification plan is to create a lake approximately 43.0 acres in size with a maximum depth of 67.0 feet.

The Vaughn Deposit Gravel Pit is located on the north side of Middle Road, approximately 350 feet west of New York State Route 240, in the Town of Concord, Erie County. The Gentner portion of the mine is approximately 1550 feet north of Middle Road and 1800 feet east of Sharp Street.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The Department has made a tentative determination to approve an application for the construction of 250 linear feet of above ground boardwalks and a 10 foot by 16 foot shelter within the southern portion (adjacent to Kinkead Ave) of the North Tonawanda Audubon Preserve which is part of the Klydel Wetlands (New York State Freshwater Wetland TE-15) located in the City of North Tonawanda. Portions of this parcel will be augmented with wood chips. This notice of complete application supercedes our February 4, 2015 notice. As a tentative determination, the Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of an activity for which a permit is sought.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a renewed Air State Facility permit which has been updated to reflect current activities at the facility to Hillcrest Industries, Inc. located in the Village of Attica, Wyoming County. This facility manufactures blasting media and reflective glass beads by drying, grinding and sizing industrial coal boiler slag, post-consumer glass, and waste glass. The facility has two emission units: Emission Unit A is the grinding room and Emission Unit B contains the two natural gas fired glass bead furnaces. Emission Unit A contains emission points 00001 and 00004 which exhaust through filtration systems and maintain the required negative pressure in the grinding room to insure fugitive emissions are not released to the environment. Emission Unit B contains emission points 00002 and 00003 - the two glass bead furnaces, which exhaust through filtration systems. The facility is under an Order on Consent, which includes a compliance schedule, Schedule A, that includes operational requirements and the submission of emission minimization plans. These include monitoring stockpiles for dust, storing fine screenings in containers, inspecting and repairing material conveying systems and emission control equipment, monitoring emission points for visible emissions, and keeping the grinding room under a negative pressure. The emission minimization plans for the above include monitoring, recordkeeping and reporting requirements as well. The on-going air-related activities and the monitoring and maintenance activities are included in the draft permit. As a tentative determination, the Department is seeking public comments prior to making a final decision on permit issuance.
