Project Description:

The Department has prepared a draft Air State Facility permit (#2-6102-00004/00006) and State Pollutant Discharge Elimination System (SPDES) permit (#NY0110001, #2-6102-00004/00009) and has made a tentative determination to issue a permit renewal and ownership transfer for an existing fuel terminal. The Hess Co. terminal located at 722 Court St. was purchased by Buckeye Terminals LLC. This facility is a petroleum loading terminal consisting of storage tanks containing distillate and residual oil, truck loading rack, and marine loading rack. The facility operates one 31.5 mmBtu/hr boiler.

The air renewal application includes a modification of one boiler to fire natural gas, No.2 or No.6 fuel oil. The facility NOx emissions from combustion sources are limited to 24.9 tons per year. Records demonstrating compliance with this cap will be kept in accordance with the permit special conditions. The facility is subject to the provisions of State Facility requirements specified under 6NYCRR 201-7. The ASF permit contains a listing of the applicable federal, state, and compliance monitoring requirements for the facility. The air application, draft air permit, relevant supporting materials and air regulations are available for review during normal business hours at the DEC office provided in this notice.

The Department intends to issue a SPDES permit renewal for a five year period, maintaining the current effluent limitations and monitoring and report requirements under the Environmental Benefit Permit Strategy (EBPS). Additional information (e.g. current permit, fact sheet, renewal application, supporting documentation, the priority ranking fact sheet, and a description of the SPDES permit priority ranking system) are available for review. Substantive comments on the SPDES permit or on the priority ranking score (e.g. changes in discharge characteristics or facility operations that affect the discharge) and/or request for hearing must be submitted in writing.
Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

State Environmental Quality Review (SEQR) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Applicant proposes to operate a temporary dewatering system to facilitate the construction of an amphitheater and park between West 21st and West 23rd Streets and the boardwalk in Coney Island, Brooklyn with a maximum withdrawal of 2,880,000 gallons per day. Pumped groundwater is to be directed to existing 42" storm sewer located on West 23rd Street which will discharge to the Atlantic Ocean via NYCDEP Outfall CI-663.

Required mitigation includes planting the steep slope at the rear of the property with shrubs and seeding as per details on the project plans.
