Project Description:

The Department has received a Mined Land Reclamation application from Marcy Excavation Services LLC for the expansion of the Van Opdorp Pit #2. The applicant proposes to expand an existing 22.3 acre clay mine by 3.9 acres within a 67.9 acre parcel. The proposed expansion area is immediately east of and adjacent to the current Life of Mine area. The site is on the Joyce Van Opdorp property, west of Silver Street and south of County Road 13, in the Town of Manchester, Ontario County.

Operation of the mine will continue surface extraction of clay from above the local water table. Excavation will remove approximately 40,000 cubic yards of additional material from the Life of Mine area. Material will not be processed on site, but will continue to be loaded directly on to dump trucks for transport off site. No change in truck traffic volume is proposed. Site access will continue to be from Silver Street along the National Grid right of way. Final reclamation will include the replacement of stockpiled topsoil and re‑seeding to restore the site to agricultural use.

Hours of operation will continue to be daylight only Monday through Friday from 7 AM until 6 PM, Saturdays 7 AM until 3:30 PM if needed, with no mining on Sundays.

The application is available for review at the Region 8 NYSDEC office, and a copy of the application materials has been sent to the Town of Manchester.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than May 22, 2015.

Project Description:

The applicant proposes to modify an existing mined land reclamation permit to change the access road location on Burgess Road. The new access road location will line up directly across from Salcman Road and be approximately 450 feet south of the originally-approved location. The modification will increase the Life-of-Mine area by approximately 1.6 acres to a total of 122.4 acres, which includes an additional 3.8 acres and removal of 2.2 acres. No other changes to the proposed operations or original mined land reclamation permit issued on July 19, 2013 are proposed.

The applicant is proposing a modification to an existing freshwater wetland permit authorizing the installation of a handicap accessible canoe/kayak ramp and improvements on existing parking. The proposed change includes a change in alignment of the previously approved gravel access path. The path will now be a combination of asphalt and concrete.
