The NYSDEC has prepared a draft permit and has made a tentative determination to renew and modify an existing SPDES industrial discharge permit (NY0086479) for the existing surface discharge of treated process wastewater to Birdsall Creek, a Class C watercourse. The modified permit is to include the addition of stormwater from Outfall 002 serving a portion of roof drains and to change outfall sampling from composite to grab to reflect the facility's batch discharges.

Project Description:

The Department has prepared draft permits and has made a tentative determination to issue renewal permits for Carr Street Generating Station. Carr Street Generating Station consists of two GE LM-6000 stationary gas turbines. The turbines fire either natural gas, number 2 fuel oil or biodiesel. Emissions of NOx from each unit are controlled with water injection and an SCR.

This permit action will renew the existing Title V operating permit. The gas turbines are subject to the federal Standards of Performance for New Stationary Sources found at 40 CFR Part 60, Subpart GG; the DEC's CO2 budget regulation, 6 NYCRR Part 242; and numerous permit conditions. Continuous emissions monitors are used to demonstrate compliance with the NOx and CO permit limits. Carr Street is also subject to the EPA's Acid Rain Program (Title IV of the Clean Air Act) and is required to obtain a Title IV permit. This permit action also includes the renewal of the Title IV permit.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. The applicant proposes development of a manufacturing facility on 6.6 acres of a 107.77 acre parcel in the Collamer Crossing Business Park in the Town of DeWitt, Onondaga County. The project consists of 69,600 SF of manufacturing space and 12,800 SF of office space, along with attendant site features (parking sidewalks, stormwater management structures, etc.). The project includes approximately 0.053 acres of permanent and 0.161 acres of temporary disturbance to the adjacent area of FWW SYE-9 a class II wetland. The Collamer Crossings Business Park was the subject of a DEIS and Findings (2001) by the Town of DeWitt acting as Lead Agency.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 2.88 Million Gallons Per Day (Million GPD) of water from the Oswego River for operation of the Huhtamaki, Inc Facility. The food container manufacturing facility has been in operation, under different ownership, since 1917. No changes in current operations from recent years are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

The applicant proposes to upgrade an existing farm road to accommodate equipment and trucks associated with gravel mining operations. The CJ Ferlito Harris Hill Mine, within the wetlands and adjacent area of FWW FU-29, a Class 2 wetland. Impacts to the wetland and adjacent area include additional fill and widening the farm road and placement of an additional culvert and an upgrade of an existing culvert to allow for improved trafficability for mining equipment and trucks. An amended negative declaration has been prepared to incorporate this recent addition to the mining proposal. The additional road fill will be removed and original contours restored when the mine is reclaimed. The project is located at 464 Harris Hill Road in the Town of Hannibal.
