The Department has made a tentative determination to reissue and modify the lapsed SPDES permit to discharge a maximum volume of 21,480 gallons per day of treated sanitary wastewater from Chaviva Properties into an unnamed tributary of Botsford Brook (DEC Water Index No. H-139-14-38-3-4-1, Class B[t]). Chaviva Properties is an existing facility located at 1106 Ulster Heights Rd., Wawarsing.

The permittee will be required to maintain records to verify compliance with the SPDES permit conditions and discharge limits. A draft SPDES permit (SPDES No. NY0165972) is available for review at the NYSDEC Region 3 office.

Project Description:

The applicant proposes disturbance to NYS-regulated tidal wetlands and installation of a docking facility in, on, or above the navigable waters of the state. The proposed facility includes construction of a new 100-foot long, 6-foot wide fixed pier and installation series of floating docks and gangways terminating in a U-shaped set of floating docks. The pier are proposed over intertidal marsh and coastal shoals; the floats and gangways are proposed over coastal shoals and littoral zone. The total dock surface will be 2,824 square feet and the new facility perimeter will be approximately 10,100 square feet. The proposed facility will serve the adjoining properties are 2 Lane Way and 3 Lane Way and the existing dock at 2 Lane Way with a surface of approximately 1,621 square-feet and a 6,500 square foot perimeter will be removed. Float stops are proposed to keep the dock off the substrate at low tide.
