Project Description:

Applicant proposes to replace existing State Route 427 bridge in slightly different alignment over Chemung River which is a Class A stream, requiring an Article 15 Stream Disturbance permit. Project will include installing a causeway at the north of the project, constructing new bridge in a nearly parallel realignment, traffic will continue use existing bridge until new bridge is in service, move traffic over to new bridge, install second causeway, remove existing bridge and piers, and remove causeways. The two temporary causeways will require a total of approximately 1,650 cubic yards of temporary fill. Rock riprap and concrete will be placed at abutments and piers for a total of approximately 1,500 cubic yards of fill for erosion protection.

Project Description:

The Applicant, Frey Concrete Inc., is proposing to expand a portion of their existing sand and gravel mine located on the north side of Dry Bridge Rd (Area #2) by adding 6.5 acres to the current approved mining limits and mine below the water table in a 7.6 acre area within the northeast portion of existing Area #2 limits. No other changes in the currently approved mining operations for the existing 835.8 acre surface sand and gravel mine are being proposed. A perimeter berm would be constructed along the new mining boundary prior to commencing mining in the proposed expansion area. During mining, sand and gravel would be loaded into a haul truck and brought to the existing plant for processing. Other than reclaiming the below water table mining area as a pond, no other changes in the previously approved reclamation plan are proposed.

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 9.74 Million Gallons Per Day (Million GPD) of water from on-site quarry sumps and wells for operation of the Stafford Quarry Facility. The limestone mining and aggregate processing facility has been in operation since 1926. No changes in current operations from recent years are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).
