Project Description:

The applicant proposes to develop and operate a 16.16 acre sand and gravel mine within a 110 acre parcel east of Otisco Valley Road, approximately 3168 feet south of Slate Hill Road in the towns of Marcellus and Otisco. Presently this location is being mined on an approved 4.4 acre Life of Mine. The mine is intended to operate as a traditional surface extraction site including excavation of unconsolidated sand and gravel reserves using a front end loader and backhoe. All mining will occur above the water table and the mine floor elevation will be 860 ft. AMSL. Material will be stockpiled as unprocessed "run-of-bank", or processed with a portable screener. Maximum processing rates for the screening operation will not exceeded 150 tons-per-hour (TPH). Final reclamation will restore the 16.16 acre site to open meadows and agriculture fields. Upland reclamation will include the replacement of stockpiled topsoil, and reseeding with guidance from Onondaga County Soil and Water Conservation District. The reviewed Life-of-Mine (LOM) area is 16.16 acres.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 610,000 gallons per day (GPD) of water for aggregate washing operations at the Constantia Center mine. The Facility has been in operation since 1983. No changes in current operations are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
