Project Description:

The applicant proposes the partial removal of Shapp Pond Dam, DEC Dam ID # NY 211-3687, which impounds NYS DEC Waters Index # H-101-21, East Branch Wappinger Creek, Class B. Approximately 40 feet of the dam's 73 foot length will be removed; approximately 24 feet will remain on the east side to maintain the structural stability of the old mill building and the remaining portion on the west bank left as a historic remnant. The rise in water elevation during the 100- year storm due to the remnants will be negligible. The flow will be diverted through a temporary culvert and the work area will be dewatered via cofferdams and a pump. A temporary access drive from Hibernia Road is proposed on the west bank and temporary fill to be placed in the stream bed to allow machinery access.

Project Description:

The New York State Department of Environmental Conservation (DEC) has received an application for re-issuance of an expired State Pollution Discharge Elimination System (SPDES) Permit, pursuant to 6NYCRR Part 750, for the discharge of 5,000 gallons per day of treated sanitary wastewater to Otter Kill (Index # H-89-20, Class C). The existing waste water treatment plant (WWTP) currently services the Sisters of St. Dominic treatment center and daycare facility. The WWTP consists of an aeration and sand filtration system with chlorine disinfection. The receiving water is an intermittent stream, and therefore the intermittent stream effluent limit criteria apply. The facility is considered a State Non-Significant Minor (Private/Commercial/Institutional), Discharge Class 02.

A draft SPDES permit with DEC proposed effluent limits and monitoring requirements is available for review at DEC Region 3 headquarters in New Paltz. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. Substantive comments on these permits or requests for a hearing or both must be submitted in writing to the contact person listed below.

Project Description:

The applicant proposes a planned integrated development, known as Tuxedo Farms (Reserve), on 2,376 acres which at full build out would consist of 1,195 residential structures, 14,000 square feet of commercial/retail space and 30,000 square feet of recreational building space, roadways, stormwater management structures and construction of a potable water supply to serve the development. The property is located westerly of Route 17 with most being within the Town of Tuxedo and a portion located within the Village of Sloatsburg, Rockland County. Development is planned to occur over three phases and will also require the following DEC permits: an ECL Article 15, Title 15 water withdrawal permit (DEC #3-3350-00044/00003; WWA #11,082); Article 24 freshwater wetland permit (DEC # 3-3350-00044/00005) and SPDES permit (#3-3350-00136/00001) for construction of a new waste water treatment plant (WWTP) and discharge of treated sanitary wastewater to the Ramapo River. In addition to serving the development, the new WWTP will replace the existing Town of Tuxedo WWTP and be constructed adjacent to the existing plant utilizing the existing SPDES permitted outfall. The SPDES permit has already been subject to public notice. The water withdrawal supply system will involve a taking (average daily demand) of 370,000 gallons per day at full build out. Water will be obtained from existing ground water wells developed on the parcel. Development has been designed to avoid NYS DEC wetlands and total proposed disturbance to the wetland adjacent area is approximately 3.8 acres. The Department is also reviewing project development for impacts to the timber rattlesnake which is listed as threatened in NYS. The current designed project proposes to preserve over nearly 70 percent of the total site as open space for passive recreational uses.

Measures have been undertaken in consultation with OPRHP to avoid or mitigate impacts to registered or eligible resources. These agreed upon measures conclude the SHPA review.
