Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems (SPDES) permit (NY#0000825) for the surface discharge treated wastewater to tributary 5A of Onondaga Lake, a class C water.

Crucible Industries manufactures high grade, stainless and tool steels. Its industrial processes includes air melting, metallurgy cementation process, open hearth furnace and other steel processes. All wastewater produced in the industrial processes receive treatment before it is discharged through outfall 001. Treatment at the facility consists of mix tank, primary clarifier, secondary clarifier, temperature control and disinfection/dehalogenation. The facility also discharges stormwater, groundwater, steam condensate, sink drain water, and cooling tower blowdown wastewater to Tributary 5A.

DEC proposes to incorporate the following modifications to this permit: A Thermal Standard Study has been added. For Outfalls 005, 008 and 012 and effluent limit for mercury has been added. A Mercury Minimization Program requirement has been added. Outfall 012 includes an action level for benzene. Whole Effluent Toxicity Testing requirements have been added. A modified version of Industrial Best Management Practices requirement has been added. A total maximum Daily Load for Phosphorus, which includes a Phosphorus Waste Load Allocation has been added. For Outfall 001 the monitoring requirement for flow for dewatered groundwater has been deleted since the excavation project has been completed, and the action levels for aluminum, selenium, and fluoride have been removed. A monthly iron monitoring requirement has been added for Outfall 012. The Water treatment chemicals requirement has been modified and included under general condition J. Individual monitoring and effluent limits have been added for Outfalls 002, 003, 008 and 012 to track stormwater discharges separately and to monitor mercury discharge through Outfalls 008 and 012 separately. A special condition has been added stating all terms and conditions in the Order on Consent shall be considered as parts of the permit.

The applicant proposes extending the Schedule of Compliance for the capital upgrade of the wastewater plant necessary for achieving the effluent limits promulgated in the Phase II Onondaga Lake Phosphorus TMDL.

The department has made a tentative determination to issue a modified permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation law.

This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.

The applicant has applied for an initial permit for the continued withdrawal of 2.6 Million Gallons Per Day (Million GPD) of water for operation of the Oneida Fish Hatchery. The fish hatchery facility has been in operation since 1992. No changes in current operations from recent years are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).
