Project Description:

The Department has made a tentative determination to approve a modification of the Title IV Acid Rain Permit as required by 40 CFR Part 72 for the applicant's Selkirk Cogeneration Project (SCP), a power generating facility located at 24 Power Park Drive, Selkirk, County of Albany, New York 12158. SCP is a natural gas fired, combined cycle facility rated at 345 MW. Modification of the permit has been requested by the permittee to include the existing Selkirk Cogen Facility Units identified as CTG201 and CTG301 as recent changes in the facility's power purchase agreement result in these units no longer meeting the previous exemption pursuant to 40 CFR 72.6(b)(5). Issuance of the modification will allow the Department to enforce the requirements of the acid rain program and require the facility to hold allowances to cover sulfur dioxide emissions and require additional reporting and monitoring. Issuance of the permit modification does not change emission requirements which are already addressed in the facility's Air Title V permit.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The project applicant, Capital Cities Imported Cars. Inc., located at 617 Route 9W, Glenmont, New York, proposes the expansion of an existing BMW/Volkswagon (VW) automobile dealership that is currently situated on 15.27± acres of land located along New York State Route 9W in the Town of Bethlehem. The expansion of the existing facility, limited to the northeast portion of the property, immediately adjacent to Route 9W, will provide an additional showroom for the VW portion of the dealership as well as to provide additional parking area for patrons and inventory vehicles. The proposed expansion area is primarily contained within lands that were previously cleared and graded in conjunction with the existing dealership facilities. Expansion activities will entail the construction of a separate 8,700 square foot showroom, with office and retail space; the addition of 16,200 square feet of new parking area for storage of inventory vehicles and to provide parking for patrons; and the establishment of a sub-surface stormwater utility to effectively collect, treat and drain excess water generated by runoff from new impervious structures. The project will disturb approximately 0.47 acres (20,473 square feet) within the adjacent area of NYS freshwater wetland D-60 (Class 2) requiring an ECL Article 24 Freshwater Wetland Permit from NYSDEC. As a form of mitigation for wetland adjacent area impacts, the applicant proposes to protect the remaining on-site wetlands and wetland adjacent areas by placing them under a deed restriction.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
