The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 024 4368, DEC Identification #: 7-0552-00028/00001), of Hidden Valley Trailer Park Facility, in the town of Sennett pursuant to 6 NYCRR Part 750‑1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The most significant proposed changes to the permit are as follows:

The modifications to Hidden Valley Trailer Park's SPDES permit include new water quality based effluent limits for ammonia, TRC and settleable solids. These modifications will reduce levels of contaminants contained in their wastewater discharge, protect the water quality of the subject watershed as well as bring the SPDES permit up to date and in compliance with all applicable laws and regulations.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 3.89 Million Gallons Per Day (Million GPD) of water from Butternut Creek for operation of the Jamesville Quarry Facility. The limestone mine and aggregate production facility has been in operation in recent years with no changes in current operations are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

The most significant proposed changes to the permit are as follows:

The modifications to the Metalico Aluminum Recovery, Inc. SPDES permit include new water quality based effluent limits for Chemical Oxygen Demand (COD), cadmium, chromium, total chlorinated phenols, surfactants, copper, lead, and zinc . New PCB limits are included based on revised PQL standards. Additional monitoring and limits for phosphorus have been added based on the Onondaga Lake phosphorus TMDL requirements. These modifications will protect the water quality of the subject watershed, as well as bring the SPDES permit up to date and in compliance with all applicable laws and regulations.

Project Description:

Applicant proposes to use approximately 900 cubic yards of medium stone to provide erosion protection along the banks of Limestone Creek where a culvert passes under Mill St. and empties into the Creek. Vegetation and stumps will be removed from the banks of Limestone Creek, and a turf mat will used to provide bank stability. Water quality certification has been requested for the entire project which includes approximately 490 feet of stream bed and bank repair to the Ledyard Canal along the section that is east of Mill Street and west of Beach Street. All work will be done in the dry and water will be pumped around the active construction sites. The project is located in the village of Fayetville, south of route 5 in the area bordered by Mill Street and Beach Street.
