Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 5.57 Million Gallons Per Day (Million GPD) of groundwater for operation of the IBM Hudson Valley Research Park Facility. The facility has been in operation since 2007. No changes in current operations from recent years are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

The Department has prepared a draft permit and has made a tentative determination to issue an Air Title V permit renewal for Wyeth Pharmaceuticals LLC located in Pearl River, Rockland County. The facility is engaged in the manufacturing and the research and development of pharmaceutical, nutritional, biological and other related products. The facility also operates a number of support functions such as warehouses, tanks, wastewater treatment and combustion related sources. The facility is a major source of Oxides of Nitrogen (NOx) and Volatile Organic Compound (VOC) emissions and is subject to Title V permitting.

Title V Permit Renewal 2

This permit renewal contains numerous, previously established, air monitoring and recordkeeping requirements. These requirements include but not limited to:

Annual restriction on NOx emissions under 6NYCRR Part 201-7. Annual fuel use and run time limits under 6NYCRR Part 201-7. Short term Carbon Monoxide emission limits under 6NYCRR Part 231-8. Short term Particulate emission limits under 6NYCRR Part 231-8. Annual fuel use and run time limits under 6NYCRR Part 231-6. Operation of Continuous Emissions Monitoring Systems under 40 CFR Part 60 Subpart GG.

This permit renewal also identifies lower Oxide of Nitrogen (NOx) emission limits in accordance with the 2011 NOx Reasonably Available Control Technology (RACT) plan that applies to Emission Units F-00001 (Boiler No. 4), F-00002 (Turbine/Boiler No. 1 and Turbine/Boiler No. 2, F-00004 (Boiler No. 5) and F-00005 (Boiler No. 3). Case by case NOx RACT emission limits are defined as follows: EU F-00005 (Boiler No. 3) - 0.15 lb NOx / MMBtu firing either natural gas or fuel oil. EU F-00001 (Boiler No. 4) - 0.23 lb NOx / MMBtu firing natural gas. EU F-00001 (Boiler No. 4) - 0.26 lb / MMBtu firing fuel oil. EU F-00001 (Boiler No. 4) - annual rolling NOx limit of 33.3 tpy. EU F-00004 (Boiler No. 5) - 0.20 lb/MMBtu firing natural gas. EU F-00004 (Boiler No. 5) - 0.30 lb/MMBtu firing fuel oil. EU F-00002 (Combined cycle No. 1 and No. 2) - 42 ppmvd (at 15% O2) firing natural gas. EU F-00002 (Combined cycle No. 1 and No. 2) - 65 ppmvd (at 15% O2) firing fuel oil. Annual boiler inspection and maintenance activities.

The Standard Industrial Classification representative of the facility is 2836 - Biological Products.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

The Department has prepared a draft permit and has made a tentative determination to issue an Air State Facility permit for the Glorious Sun Robert Martin facility (Blue Hill Plaza), a 1.1 million square foot office complex located in Pearl River, Rockland County. The facility consists of three dual fuel-fired boilers, two 71 mmBtu/hr units and one 19.6 mmBtu/hr unit, emitting through a single stack, and eight diesel generators, each with a separate stack. The boilers fire natural gas primarily and use No. 2 oil as a backup fuel.

The facility utilizes three boilers to provide thermal load to the facility. Also used on site are eight existing generators, where each generator may be enrolled and supply power in the NYISO demand response program. In order to keep NOx emissions below the major source level, caps for fuel use in the boilers and hourly use per year for each generator are established. The fuel use in the boilers (aggregate) is capped at 73 mmcf/yr of natural gas and 50,000 gal/yr of No. 2 fuel oil. The eight generators are capped to each being available no more than 100 hours/yr. In this way, the NOx cap in the permit is maintained at 22 tons/yr. As a minor source, the facility is not subject to the Title V permitting requirements of 6 NYCRR Part 201-6.

The facility is subject to monitoring, reporting and recordkeeping requirements under 6 NYCRR Part 201, 6 NYCRR Part 225 and 6 NYCRR Part 227. The facility is also subject to 40 CFR 60 Subpart IIII and 40 CFR 63 Subpart JJJJJJ federal requirements. Air state facility permits expire after ten years, as per 6 NYCRR Part 201-5.2(c). The Standard Industrial Classification representative of this facility is 6512 - Nonresidential Building Operators.
