PE - Bayshore LLC Emission Reduction Credits

New York State Department of Environmental Conservation (NYS DEC) is providing supplemental notice pursuant to 6 NYCRR Part 231-10.4 for the purpose of correcting an error reflected in the initial public notice for PE - Bayshore LLC, dated February 4, 2015 at: http://www.dec.ny.gov/enb/20150204_reg1.html#147280014100016, relating to NYS DEC's tentative approval of an application to establish emission reduction credits (ERCs). The initial notice identified the amount of ERCs reflected over a 24 month baseline period rather than on an annual, tons per year, basis. In addition, the baseline period should have reflected the correct 24 month period from 10/01/2009 to 09/30/2011. Therefore, the 24 month baseline period is 10/01/2009 to 09/30/2011 and the correct amount of ERCs as reflected on an annual basis that are approved by NYS DEC are 43.21 tons per year of oxides of nitrogen (NOx) and 4.07 tons per year of volatile organic compounds (VOC).

Negative Declaration

Suffolk County - The incorporated Village of Port Jefferson Planning Board, as lead agency, has determined that the proposed 201 West Broadway Apartment Complex will not have a significant adverse environmental impact. The proposed project is a 3.74 acre property at 201 West Broadway, 95 feet west of Barnum Avenue straddling the Mill Creek, in the incorporated Village of Port Jefferson, New York. The property is split zoned and is within the Central Commercial (C-1) and Single-Family Residence (R-B2) zoning districts. The project involves the demolition of an existing motel and redevelopment with a 3 story apartment complex with 112 apartments at 30 units per acre and 178 parking spaces. Under the proposed complex and courtyard will be a subterranean parking structure housing 168 parking spaces and a building entrance all located on the north side of Mill Creek. The first floor includes 36 units and a courtyard on the north side of the Creek and 10 parking spaces on the south side of Mill Creek and a bridge will cross over Mill Creek. The second and third floors will each have 38 dwelling units.

The applicant seeks the following permits and approvals: Village of Port Jefferson Planning Board site plan and conditional use approvals and accessory parking within a residential zone; Village of Port Jefferson Building Department demolition and building permits; New York State Department of Transportation (NYS DOT) Highway Work Permit; New York State Department of Environmental Conservation (NYS DEC) SPDES General Permit; Suffolk County Department of Public Works Approval of Building Permit; Suffolk County Department of Health Sanitary Waste Disposal and Water Supply Facilities; Suffolk County Industrial Development Agency Approval of Tax Incentives; and Suffolk County Water Authority water supply connection.

Conditioned Negative Declaration

Suffolk County - The Town of Southampton Planning Board, as lead agency, has determined that the proposed Elite Towers and AT&T of Bridgehampton will not have a significant adverse environmental impact provided specific conditions are met. There will be a 30 day public comment period commencing with the date of this notice.

The action involves the construction of a 120 foot tall monopole wireless telecommunications facility on a 16,213 square foot parcel improved with an existing warehouse storage building with accessory parking. The project is located on a 16,213 square feet parcel in the LI-40 Zoning District in the Aquifer Protection Overlay District located at 61 Foster Avenue in the Hamlet of Bridgehampton, Town of Southampton, New York.

The conditions are:

The monopole wireless facility shall have no exterior antennas and the maximum total height is to be 12 foot tall to be established through a declaration of covenants.
