Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 923,040,000 GPD of water for operation of the Roseton Generating Station. The Facility has been in operation since the 1974. No changes in current operations are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that permit renewals, and the issuance of "initial permits" under ECL section 15-1501.9 as implemented by 6 NYCRR 601.7, are Type II actions and not subject to SEQR.

The 1200-megawatt coal fired station is located on the west bank of the Hudson River approximately 4 miles north of the Newburgh-Beacon Bridge. The facility uses water withdrawn from the Hudson River for once-through cooling with the intake structure for the facility regulated under SPDES permit 3-3346-00075/00001.

Article 19 Air Title V Facility

Project Description:

The Department has prepared a Draft Title V Permit modification 2 for the Metal Container Corp facility pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law and Title V of the Federal Clean Air Act Amendments. Metal Container Corp, located in the Town of New Windsor, Orange County, New York, operates an existing facility which manufactures two piece aluminum beverage cans.

Permit modification 2 accounts for the conversion of can line 1 from exclusively producing 12 ounce cans to producing both 12 ounce and 16 ounce cans. This conversion requires physical equipment changes to the manufacturing frontend bodymakers as well as re-designating equipment supporting backend coating operations. Producing 16 ounce cans will replace a portion of the 12 ounce can manufacturing capabilities resulting in a project VOC emission potential of 32.89 tons per year. Non-attainment new source review (NNSR) does not apply to this project.

This permit modification 2 also addresses the continuation of the Big Can project previously permitted as Renewal 2 Modification 1 (2012). The Big Can continuation represents a realignment of the manufacturing line speed resulting in a potential VOC emissions increase of 3.94 tons above the original 2012 review. Because the original 2012 Big Can project was subject NNSR, the facility is required to utilize 4.53 tons (3.94 x 1.15 = 4.53 tons) of VOC emission reduction credits to comply with 6NYCRR Part 231. Specific conditions representing Lowest Achievable Emission Rate (LAER) remain in effect as previously permitted. The source of emission reduction credits is the Metal Container Corp. as described above.

This permit modification contains a number of revised monitoring, recordkeeping and reporting requirements under 6NYCRR Parts 201 and 231.

The Standard Industrial Classification Code for this facility is 3411 - Metal Cans and Shipping Containers

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Project Description:

The Department has made a tentative determination to approve this application to re-issue a SPDES permit which had been allowed to expire for an existing surface discharge of up to 325,000 gallons per day (gpd) of treated sanitary wastewater from the Village of Bloomingburg wastewater treatment plant (WWTP) into the Shawangunk Kill, Class B(t). The expired SPDES permit had contained interim effluent limits which allowed the expansion of the Village WWTP. The draft SPDES permit reflects completion of the final construction phase of the expanded WWTP, and it contains new temperature and flow monitoring requirements. No other changes to permit effluent limits or other monitoring requirements are proposed. The project is located on Old Route 17 (Main Street) in the Village of Bloomingburg. A draft permit is available for inspection and comment at the regional office.
