Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue an Air Title V Permit Renewal for an existing facility Kings Plaza Energy LLC, which provides power, heating, and cooling for the Kings Plaza Shopping Center. The facility has two 16.7 mmbtu/hr Cleaver Brooks boilers which are ducted to a single stack, four 3.2 MW Deutz natural gas spark fired engines ducted to four separate emission points and two emergency diesel generators. The fuel for the boilers is natural gas as primary and number 2 fuel oil as secondary.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 4.32 Million Gallons Per Day (Million GPD) of water from the Hudson River, for operation of the power Facility. The power plant facility has been in operation since 1974. No changes in current operations from recent years are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a renewal of an existing Air State Facility permit. The hospital operates one 2370 kW diesel engine/generator (EU0001), three identical 29.3 mmBtu/hr boilers firing natural gas or #2 fuel oil (EU0002), and six diesel fired emergency generators (exempt activities). This renewal includes a modification to address the removal of the ethylene oxide sterilizer (EU00003) and the installation of six emergency power diesel fueled engine/generators. NOx emissions are capped at 24.9 tons/yr.

The facility is subject to the provisions of State Facility requirements specified under 6NYCRR 201-7. The Air State Facility permit contains a listing of the applicable federal, state, and compliance monitoring requirements for the facility. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

Project Description:

On February 4, 2014, the Department made available for public review and comment, a draft SPDES permit for Stormwater Discharges from MS4s Owned and Operated by the City of New York. Numerous comments were received during the public comment period that resulted in changes to the draft Permit. The Department has prepared a revised draft MS4 Permit that addresses the comments received, where appropriate. The revised draft MS4 permit and Fact Sheet summarizing the changes from the previous version are available for review on DEC's website at: http://www.dec.ny.gov/chemical/41392.html. The Department will accept comments on the changes until April 10, 2015 or 30 days after publication of this notice, whichever is later.
