Project Description:

Rockland County Solid Waste Management Authority ("Authority") has acquired the solid waste management operations, equipment, and associated property located at 166 South Route 303, West Nyack, New York, formerly owned and operated by the Town of Clarkstown ("Town"). Solid waste management activities were historically conducted on this property ("Clarkstown Site") under the oversight of the Town's Department of Environmental Control, pursuant to permits issued by the NYSDEC.

In order to ensure compliance with the State's Solid Waste Management Regulations, the Town and NYSDEC entered into Order on Consent Case Number R-320080502-15 ("the Consent Order"), executed by the Town Supervisor on February 13, 2009. Under the terms of the acquisition agreements between the Town and the Authority, the Authority is responsible for implementing the Consent Order requirements. As part of the transfer of ownership, the Authority was required to submit a Permit Modification Application to NYSDEC that consolidates the six separate operating facilities comprising the Clarkstown Site into one "Umbrella Permit".

These six facilities include the following:

  1. A Solid Waste and Construction and Demolition Transfer Station, currently operating under NYSDEC Permit No. 3-3920-00166/00003, with the inclusion of processing light industrial waste.
  2. A Recyclables Transfer Area that is currently operating under NYSDEC Registration No. 44W07, validated by NYSDEC on June 8, 2009. This facility handles source separated, non-putrescible solid waste.
  3. A Yard Waste Composting Facility, currently operating under NYSDEC Permit No. 3-3920-00152/00004.
  4. A Construction and Demolition Debris Processing Facility that is currently operating under NYSDEC Registration No. 44W07, validated by NYSDEC on June 8, 2009. This Facility receives only recognizable uncontaminated concrete and asphalt pavement.
  5. A Wood Mulching Facility that is currently operating under NYSDEC Registration No. 44W07, validated by NYSDEC on June 8, 2009. This Facility receives and processes only branches logs and stumps, and brush generated by yard clean up and tree-felling activities.
  6. A Public Yard Waste Drop-Off Area, where residents drop off brush, leaves, and grass. This Public Drop Off Area is located on the northern end of the Transfer Station Site.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Rockland County Dept of Solid Waste Management

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The applicant has applied for an initial permit for the continued withdrawal of 2.16 Million Gallons Per Day (Million GPD) of water from an on-site pond and four on-site wells for irrigation of the Westchester County Club. The golf course facility has been in operation since 1992. No changes in current operations from recent years are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).
