Project Description:

New York State Department of Environmental Conservation (NYS DEC) is considering issuance of a General Permit (GP) to the Yates County Soil and Water Conservation District (SWCD) to cover various stream maintenance, stabilization and crossing projects conducted by the Yates County SWCD and their cooperators. The following is a list of activities being requested for authorization under this GP:

1) one stream crossing of less than 25 feet wide in any 1,000 lineal feet of stream length for machinery;
2) removal of up to 750 cubic yards of accumulated channel material and bank or shoal shaping involving not more than 2,000 lineal feet of stream channel;
3) removal of trees and/or debris other than bed material blocking or impeding drainage or navigation and/or jeopardizing the banks of a stream or structure;
4) placement of rock riprap for up to 500 feet in any 2,000 lineal feet of stream for bank stabilization;
5) placement of up to four bed sills in any 2,000 lineal feet of stream, for stream bed grade control;
6) implementation of stream bank bioengineering practices in less than 2,000 lineal feet of stream;
7) installation of up to 12 in-stream stabilization structures, including but not limited to rock vanes or cross vanes, and habitat enhancement (e.g. cover stones) within any 2,000 lineal feet of stream;
8) maintenance, repair, in-kind and in-place replacement, or minor modification of existing structures, including but not limited to riprap, retaining walls, gabion structures, headwalls, and plunge pools, within streambanks, stream channels, and regulated NYS DEC freshwater wetlands and their adjacent areas;
9) maintenance, repair or replacement of existing culverts, and bridges;
10) installation of dry hydrants. Once issued, the Yates County SWCD would be required to request project-specific coverage under the General Permit for cooperating partners and municipalities throughout the term of the permit, which would be three years.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

Negative Declaration

Monroe County - The Town of Greece Town Board, as lead agency, has determined that the proposed Orchard View Senior Citizen Apartments will not have a significant adverse environmental impact. The action involves the rezoning 51.7 ± acres of real property from R1-44 (Single-Family Residential) to RMS (Multiple-Family Residential - Senior Citizen). The applicant/project Sponsor proposes to construct 430 ± dwelling units (80 ± one-story townhouses; 350 ± apartments in 12 to 14 two-story buildings) for rental to senior citizens, with an accessory clubhouse, related utilities, grading, landscaping/buffering, paved driveways and parking, and other site modifications. The Premises currently consist of an unused part of an apple orchard. Site modifications include removal of soil that contains lead, arsenic, and DDT and its associated breakdown compounds, DDD and DDE. The upper one foot of soil on the Premises will be removed and used to construct berms in a soil storage area. A vegetative cover will be established on these berms to prevent erosion; the vegetative cover also will reduce and minimize human exposure to airborne dust from the soil. The proposed vehicular access for the project is via a driveway at the signalized intersection of Latta Road (New York State Route 18, a four-lane urban minor arterial) and Kirk Road (Monroe County Route 262, a local collector). Existing land uses in the vicinity consist of single-family houses, a place of worship, senior citizen residential facilities (assisted living and memory care), apartments, and agricultural uses (principally, orchard). The project is located at 2451 to 2455 Latta Road (NYS Route 18), on the south side, in the Town of Greece, New York.

Ontario County - The Town of Victor Town Board, as lead agency, has determined that the proposed Amendment to the Allowable Uses in the Town of Victor's Light Industrial Zoning District will not have a significant adverse environmental impact. The action involves the amendment of Chapter 211 of the Victor Town Code, specifically with regard to allowable uses in the Light Industrial Zoning District (Section 211-24). Appropriate not-for-profit uses will be included as an allowable use within the Town of Victor's Light Industrial Zoning District. The project is located throughout the Town of Victor, New York.

Ontario County - The Farmington Town Board, as lead agency, has determined that the proposed Local Law #3 of 2015 Monarch Manor Incentive Zoning Official Zoning Map will not have a significant adverse environmental impact. The action involves a Legislative Action only approving the rezoning of land containing a total of 52.6 acres from RR 80 (Rural Residential) to 12 Incentive Zoning for the Monarch Manor Incentive Project. The project is located on the northeast corner of New Michigan Road and Canandaigua Farmington TL Road in the Town of Farmington, New York.
