Project Description:

The applicant proposes a new 11.6 acre life of mine sand and gravel mine, with a 4.2 acre affected area on property owned by the applicant. The estimated life of mine is 40 years. The use of crushing and screening equipment is proposed on site. Hours of operation would be Monday - Friday from 7am to 5pm, with no mining occurring on weekends or legal holidays. Upon completion of mining activities the land would be reclaimed to a grassland. The site is located approximately 2,000' to the east of NYS Route 3 near the Saranac Lake Water and Wastewater facility in the Town of St. Armand, Essex County. This project is also jurisdictional with the APA #2014-137.

The applicant has applied for an initial permit for the continued withdrawal of 9.00 Million Gallons Per Day (Million GPD) of water from the Mohawk River for operation of the Mohawk Fine Papers Facility. The paper manufacturing facility has been in operation since 1931. No changes in current operations from recent years are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

The applicant has applied for an initial permit for the continued withdrawal of 7.02 Million Gallons Per Day (Million GPD) of water from a combination of the North Creek Reservoir, Hudson River and on-site wells for operation of the Gore Mountain Ski Area facility. The snow making facility, approved in 1995, has been in operation with its current withdrawal rates since 2006. No changes in current operations from recent years are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Applicant has applied for a Title V facility permit modification to allow for annual stack testing of carbon monoxide (CO) to establish an emission factor used in complying with their Prevention of Significant Deterioration (PSD) cap. Annual stack testing is intended to replace a current permit monitoring requirement for the facility's CO Continuous Emissions Monitoring System. This modification pertains to the Commonwealth Plywood Inc facility at 10068 US RT 4, Whitehall.

In accordance with 6NYCRR Parts 621.7(d)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.
