The New York State Department of Environmental Conservation (NYS DEC) has received a Brownfield Cleanup Program (BCP) application from Jefferson at Saw Mill River, LLC for a site known as One Lawrence Street, site ID #C360146. This site is located in the Town of Greenburgh, within the County of Westchester, and is located at 1 Lawrence Street. Comments regarding this application must be submitted no later than March 27, 2015. Notice of Conservation Easement

Pursuant to Title 3, Article 49 of the Environmental Conservation Law, the New York State Office of Parks, Recreation and Historic Preservation (NYS OPRHP) hereby gives public notice of the following:

Notice is hereby given, pursuant to Section 49-0305 (9) of the Environmental Conservation law, of the NYS OPRHP's intent to acquire a Conservation Easement from Black Rock Forest Preserve over certain lands located at 129 Continental Avenue, Cornwall, in the County of Orange and the State of New York.

Negative Declaration

Dutchess County - The Town of East Fishkill Planning Board, as lead agency, has determined that the proposed Minor Zoning Text Revisions to §194-91.1 Workforce Housing will not have a significant adverse environmental impact. The proposed Local Law would revise §194-91.1 Workforce Housing of the East Fishkill Town Code. The Local Law would include minor text amendments to the following:

1) The intent of the Workforce Housing special permit proposed revisions would align the intent of the Workforce Housing special permit with Dutchess County's 'Three-County Regional Housing Needs Assessment: Dutchess, Orange and Ulster Counties From 2006 to 2020."

2) The approval authority for the Workforce Housing Law proposed revisions would grant approval authority of the special permit to the Planning Board rather than the Town Board to make it more consistent with other special permits and to streamline the permitting process;

3) Increase minimum size of site proposed revisions would increase the minimum site size to ten net acres as determined in accordance with §194-91.1 G (1). The current minimum site size is five net acres. This increase in site size would allow greater flexibility for site design and likely reduce the potential for any significant adverse environmental impacts by allowing for larger buffers.

The project is located throughout the Town of East Fishkill, New York.

Orange County - The Town of Wallkill, as lead agency, has determined that the proposed Water Systems Modernization will not have a significant adverse environmental impact. The action involves the installation of backup power systems, wireless communications, and data acquisition and Monitoring capabilities, as part of an overall modernization of the Town of Wallkill's water system and components. The project is located at 99 Tower Drive in the Town of Middletown, New York.

Correction Negative Declaration

Rockland County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Petersen Boatyard/Marina Expansion will not have a significant adverse environmental impact. The action involves the modification of the existing permit for excavation/fill in navigable waters and installation of docks/platforms. The additional work includes installation of a two pile-supported platforms for a boat travel-lift requiring 91 additional piles, approximately 2,065 square feet of new, associated, floating service platforms, re-location of previously-approved platforms, and excavation and fill of a peninsula area. The excavation and fill is proposed to provide a more uniform bulkhead line and will result in a net restoration of 428 square feet of river bottom. The project is located at Van Houten Street in the Village of Upper Nyack, New York.

Positive Declaration and Public Scoping

Orange County - The Village of Kiryas Joel Board of Trustees, as lead agency, has determined that the proposed Petition for Annexation of 507 Acres from the Town of Monroe to the Village of Kiryas Joel may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. Written comments on the draft scope of the Draft GEIS will be accepted through close of business March 10, 2015 and directed to: Tim Miller Associates, Inc., 10 North Street, Cold Spring, NY 10516. A public scoping session will be held on March 3, 2015 at 7:00 p.m. at the Bais Rachel Paradise Hall, 5 Israel Zupnick Drive, Monroe, NY 10950. In the event there are a large number of people wishing to provide verbal comments, a time limit of 3 minutes per person will apply.

The action involves the proposed annexation of a territory from the Town of Monroe to the Village of Kiryas Joel consisting of approximately 507 acres, comprised of 177 tax lots. The annexation petition is made by the owners of a majority in assessed valuation of the real property in the territory proposed to be annexed according to the 2013 Final Assessment Roll of the Town of Monroe, dated June 20, 2013. No specific plans for development have been submitted.

The project is located in the northeast corner of the Town of Monroe / Village of Kiryas Joel, New York.

Positive Declaration

Ulster County - The City of Kingston, as lead agency, has determined that the proposed Kingston Waterfront Brownfield Opportunity Area Plan Adoption and Implementation may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves the intended adoption and implementation of the Kingston Waterfront Brownfield Opportunity Area Plan (BOA Plan). In 2010 the City of Kingston completed a BOA Step 2 - Nomination Study and subsequently has been awarded a grant from the New York State Department of State (NYS DOS), C303892, for a BOA Step 3 - Implementation Strategy. The BOA Plan (inclusive of the Step 2 Nomination Study and Step 3 Implementation Strategy) is being prepared in accordance with the guidelines established by the NYS DOS for the BOA grant program. The BOA includes the waterfront area between Dock Street / Abeel Street and the confluence of Rondout Creek and the Hudson River at Kingston Point.

The BOA Plan will guide redevelopment of the approximately 185 acre BOA, including possible remediation of several strategic brownfield sites adjacent to parkland, commercial and residential areas, and the Hudson River and Rondout Creek. The BOA Plan will recommend possible development scenarios for vacant and underutilized brownfields, the implementation of which would likely result in new commercial, retail, entertainment, residential and/or public open space land uses. The purpose of the BOA Plan will be to build upon the Local Waterfront Revitalization Program (LWRP) and LWRP Implementation Plan to create redevelopment opportunities on former industrial brownfields. The project is located on 192 Acres of Waterfront in the City of Kingston, New York.

Notice of Acceptance of Draft EIS and Public Hearing

Westchester County - The Town of Somers Town Board, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Somers Crossing - Applicant: Boniello Land and Realty Ltd. A public hearing on the Draft EIS will be held on March 5, 2015 at 7:00 p.m. at the Somers Town House, 335 Route 202 , Somers, NY 10589. Written comments on the Draft EIS will be accepted until march 16, 2015. The Draft EIS is available from the Town of Somers Town Clerk; the Somers Public Library and on line at: www.somersny.com/pages/SomersNY_Planning/environment.

The action involves a petition requesting Amendment to the Town Code to create a new Multifamily Residence Downtown Hamlet (MFR-DH) District Floating Zone with consideration of its application to a specific site. The proposed floating zone would be applicable to any property located within 2,500 feet of the intersection of Routes 100 and 202, and other considerations.

Once enacted the MFR-DH district regulations would be applied to a 26.68 acre property. The applicant's proposal includes development of 80 multifamily residential units accessed from Route 100, a 19,000 square foot neighborhood grocery store accessed from Route 202, and preservation of permanent open space in the Somers Hamlet. The parcel has wetland and steep slope constraints and is located within a Groundwater Protection Overlay District. The property is currently zoned R-40 and R-80 Residence District.

The project is located at 307 New York State Route 100 in the Town of Somers, New York .
