The NYSDEC is pursuing a Department Initiated Modification to the existing discharge permit SPDES NY0262552 for the Village of Whitney Point pursuant to 6NYCRR Part 750-1.18, NYS Environmental Benefit Permit Strategy (EBPS). The most significant proposed changes to the permit are: change Total Nitrogen limit from monthly average to 12 month rolling average; and Mercury Minimization Program for Low Priority POTW's has been added to conform to DEC policy DOW 1.3.10.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a Title V permit renewal for the operation of the sodium nitrite manufacturing facility, subject to Title 6 of the Codes, Rules and Regulations for the State of New York (6 NYCRR), Part 201-6.1 which will install selective catalytic reduction (SCR), on two identical chemical production trains, to control nitrogen oxide (NOx) emissions at the facility. This permit includes, reference to satisfaction of a requirement by the State of New York, to install Best Available Control Technology (BACT) at the facility (under Part 212.5(d)), and satisfaction of the necessity to apply reasonably available control technology (RACT) for reduction of NOx emissions (case-by-case, under Part 212.10(c)(3)), which also requires a source-specific State Implementation Plan (SIP) revision which will be submitted to the Environmental Protection Agency (EPA).

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Article 23 Title 27 Mined Land Reclamation

Project is Located:

Palermo, Oswego County

Project Description:

The applicant proposes to renew and expand an existing 36.3 acre surface sand and gravel mine by 19 acres within a 101.8 acre parcel of land. Also included in the application is a reduction of the existing Life of Mine by .40 acres resulting in a proposed 54.9 acre LOM. The project site is the applicant's property located on Island Road south of County Route 45. Excavation will continue to be done by mechanical equipment, standard for sand and gravel mining operations. Material will be stockpiled for use in the reclamation plan. Final reclamation will restore the site to agricultural fields. The reviewed Life-Of-Mine (LOM) area is 54.9 acres.

State Environmental Quality Review (SEQR) Determination:

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
