Project Description:

The applicant has applied for an initial permit for the continued withdrawal of up to 2,880,000 gallons per day (GPD) of water for operation of the Titus Mountain Family Ski Center. The Facility has been withdrawing water from the Salmon River for snowmaking since at least 1983. No changes in current operations are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

State Environmental Quality Review (SEQR) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has made a tentative determination to issue a State Pollutant Discharge Elimination System (SPDES) permit renewal for the Washington Correctional Facility under Article 17 of the Environmental Conservation Law. The proposed permit renewal includes modified permit conditions to meet new regulatory requirements. Changes include the following: 1) addition of Special Condition requiring permittee to comply with the requirements of 6NYCRR Part 374-4: Standards for the Management of Elemental Mercury and Dental Amalgam Wastes at Dental Facilities; 2) effluent limit for parameter Phosphorus, Total has been decreased to 0.33 gm/L; 3) monitoring for the parameters Chemical Oxygen Demand (COD), Dissolved Oxygen (DO), Coliform, Total and Coliform, Fecal in effluent has been added; 4) effluent monitoring for the parameters Bis (2-ethylhexyl) phthalate and 4-Methylphenol has been discontinued based upon the collection of sufficient data demonstrating these parameters are no longer considered to be in the effluent in sufficient concentrations to warrant continued monitoring; and 5) Action Level effluent monitoring limit for the parameter Cadmium has been increased to 0.1 lbs/day to correct an error in previous permits. Please note that when the Department updates a permit this typically includes updated forms incorporating the latest general conditions. This tentative determination indicates that the discharge regulated under this statute has been found to satisfy regulatory standards for permit issuance based on a Department review of the provided information. The Department seeks comments on the proposed permit issuance prior to making a final decision. Please refer to the referenced application number when providing comments
