Positive Declaration

Ontario County - The Town of Victor Planning Board, as lead agency, has determined that the proposed Victor Crossing may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves a request by the project sponsor to change the hours of operation for a 93 acre commercial shopping center to allow the shopping center to operate between the hours of 11:00 p.m. and 7:00 a.m. which had been previously restricted. Existing light poles within the main parking field and along the entrance drive would remain on between the hours of 11:00 p.m. and 7:00 a.m. while the area behind the buildings would be maintained as shown on the current after hours lighting plan.

The project will continue to restrict deliveries between 11:00 p.m. and 7:00 a.m., so there will be no deliveries between those times, consistent with the 2006 Findings Statement. The project will also continue to restrict snow plowing and trash pickup behind the buildings between 11:00 p.m. and 7:00 a.m.

The project is located on the east side of NYS Route 96 and north of the I-490 intersection with I-90 (NYS Thruway) in the Town of Victor, New York.
