The applicant proposes to add 21.6 acres of land (Western Acreage) to its presently permitted 240.75 acre Freedom Plant/Borer Deposit sand and gravel mine. The additional acreage includes 20.2 acres near the center of the western property line and a 1.4 acre isolated wetland located immediately north of the processing plant. There will be no excavation into the groundwater table and no other changes proposed to the existing mining operation. The Western Acreage will be reclaimed to land suitable for agriculture.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a renewal of the Air State Facility Permit for the State University of New York at Buffalo South Campus located at 3435 Main Street, Buffalo, New York. The State University of New York at Buffalo uses the Mackay Power Plant to supply steam for heat, humidity, autoclaves, cage washers and pure water systems through the South Campus. The Mackay Power Plant consists of three 72.6 million Btu/hr natural gas/#2 oil low NOx package water tube boilers. Other equipment at this facility includes one 25 million Btu/hr natural gas boiler, one lab animal facilities incinerator, and one human anatomy crematory. The draft permit limits emissions of oxides of nitrogen (NOx) and carbon monoxide (CO) to below Title V thresholds. The Department is seeking public comment prior to making a final decision on permit issuance. A draft permit is available for review.

The applicant has applied for an initial permit for the continued withdrawal of 184,320 Gallons Per Day (GPD) of water from an on-site well for operation of the Frey Concrete Facility . The Facility manufactures ready mix concrete and has been in operation since the mid-1950s. No changes in current operations from recent years are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).
