Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 2.016 million GPD of water for operation of the Bonduelle USA food processing plant. The withdrawal is from two ponds located on their property. The Facility has been in operation since the 1920s. No changes in current operations from recent years are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Project Description:

Exelis Inc. (formerly ITT Industries Space Systems) has submitted an application for a new Air State Facility Permit for surface coating and other operations associated with the manufacture of optical components at its facility in the Town of Greece. To date, operations have been authorized by an air facility registration. The facility moved equipment from its Springfield MA facility therefore the production capacity has increased such that the facility is now subject to 6NYCRR Part 228-1, because the facility-wide potential to emit is greater than the 3 ton per year (TPY) threshold of volatile organic compounds (VOC). The facility will remain below Title V thresholds.

Exelis Inc. has indicated that coating lines 1 and 2 require the use of non-compliant coatings, and has provided the Department with RACT information sufficient to obtain a process specific variance from RACT requirements, based on technical and economic infeasibility of control technology as specified in Part 228-1.5(e)(1).

The Draft permit includes a proposed RACT variance from Part 228-1.3 for Surface Coating Processes which will require federally enforceable requirements and a VOC limit of 10 TPY. The Department is required to seek comments and address any significant issues on the Draft permit prior to making a final decision.

The applicant has applied for an initial permit for the continued withdrawal of 4.0896 Million Gallons Per Day (MGD) of water for operation of the Oak Hill Country Club.1.728 MGD is drawn from Allen's Creek and 2.3616 MGD from the Erie Canal. The Facility consists of two golf courses and has been in operation in its current configuration since prior to 1990. No changes in current operations from recent years are proposed.

Project Description:

The Department has made a tentative determination to authorize a proposed temporary disturbance for maintenance activities on the existing Enterprise TE Products Pipeline, located in the Catharine Creek Wildlife Management Area, within regulated freshwater wetland (FWW MF-1, Class 1). The applicant proposes to excavate a 12 x 12 x 6 foot deep area, utilizing a Caisson Box measuring 13-feet high, resulting in temporary placement of 32 cubic yards of soil on wooden construction mats in wetland, for a total estimated temporary impact of 0.46 acres of wetland. Limited use of marsh hoe (an amphibious vehicle) will be required within the wetland to get equipment to and from the location. The work will be done within restrictive dates to prevent impacts to breeding birds. The file is available for review and comment at NYSDEC Region 8.
