Project Description:

The Department has prepared a draft permit and made a tentative determination to issue a State Facility Permit for the Fab 8 semi-conductor wafer manufacturing facility. Fab 8 currently operates under two Title V Permits that were required because the facility is a major source of greenhouse gas (GHG) emissions. On June 23, 2014, the U.S. Supreme Court issued a determination that greenhouse gas emissions alone would not cause a facility to be classified a major source which would require a Title V Permit. Since the Fab 8 facility is a minor source for all other contaminants, the Title V Permits are no longer appropriate.

Wafer fabrication processes are controlled by scrubbers or thermal oxidizers. These control devices keep emissions from those sources below major source thresholds and keep ambient air impacts below State guideline concentrations. Stack testing will be performed to confirm the effectiveness of these control devices. The permit also includes caps on emissions of nitrogen oxides and carbon monoxide which are emitted primarily from boilers and emergency generators. These emissions are limited to not more than 90 tons per year which is below the major source limits.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 6.0 million GPD of water for operation of the Irving Tissue Paper Mill Facility. The Facility has been in operation since the late 1800s. No changes in current operations from recent years are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

The applicant has proposed to expand their existing +/- 3.5 acre sand and gravel mine by +/- 4.0 acres, for a total Life of Mine of +/- 7.5 acres. The mine is located on the west side of County Route 49, approximately 2 miles north of its intersection with NYS Route 29. The mine will continue to operate as a traditional surface opening extraction with material removed by mechanical excavation and processing by screening. Mining below the water table is proposed with a final reclamation objective for the site being a +/- 5.0 acre pond.
