Project Description:

The applicant proposed modification of the existing permit for excavation/fill in navigable waters and installation of docks/platforms. The additional work includes installation of a two pile-supported platforms for a boat travel-lift requiring 91 additional piles, approximately 2065 square-feet of new, associated, floating service platforms, re-location of previously-approved platforms, and excavation and fill of a peninsula area. The excavation and fill is proposed to provide a more uniform bulkhead line and will result in a net restoration of 428 square-feet of river bottom.

Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The New York State Department of Environmental Conservation (DEC) has received an application for a Protection of Waters Permit, pursuant to 6NYCRR Part 608, required by the Town of Clarkstown to construct the proposed Cranford Drive Flood Amelioration Project. The proposal includes modification of approximately 4,000 linear feet of the bed and banks of a tributary of West Branch Hackensack River [Water Index No. NJ-1-12-3, Class C(T)], also known as the Demarest Kill. The purpose of the project is to provide flood relief to residential properties currently located within the FEMA mapped 100 year floodplain associated with the Demarest Kill. A Local Floodplain Development Permit has been issued by Town of Clarkstown Department of Environmental Control. A Conditional Letter of Map Revision (LOMR) has been issued by the Federal Emergency Management Agency (FEMA).

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 3.1 million Gallons Per Day (GPD) of water from on-site wells for operation of the Wyeth Pearl River NY Facility . The Facility is a manufacturing and research campus and has been in operation since the 1940s. No changes in current operations from recent years are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

The applicant proposes to hydro-raking plant matter and up to 4 feet of soft sediments from 6.6 acres of the 50-acre Lake Dutchess, NYS WIN H-31-P44-23-P59-6-P63-2-P65a. Turbid releases from the lake are proposed to be controlled through the installation of a screen at the dam outlet, which is within the 100-foot adjacent area of NYS-regulated freshwater wetland LC-6. The dredge material will be deposited at a near-by facility, more than 100-feet from any waterbody or wetland.
