Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 4.32 million GPD of water for operation of the O-At-Ka Milk Products Cooperative. The Facility has been in operation since 1959. No changes in current operations from recent years are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume. The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Project Description:

Hammer Packaging Corp has submitted an application for a new Air State Facility Permit for printing and coating operations at its Wallace Way facility in the Town of Gates. The facility prints product labels on film and converts pre-printed plastic shrink-wrap labels into packaging sleeves. To date, operations have been authorized by an air facility registration under which actual emissions of volatile organic chemicals (VOCs) were required to be below half of regulatory threshold levels in part 228-1, or less than 5 ton per year (TPY).

With this application, Hammer Packaging proposes increase emissions of VOC above 5 TPY and to establish an alternative emission limit under RACT provisions of 228-1. Hammer Packaging has indicated that a film bonding process involved requires the use of non-compliant coatings, and has provided the Department with RACT information sufficient to obtain a process specific variance from RACT requirements, based on technical and economic infeasibility of control technology as specified in Part 228-1.5(e)(1). To obtain this variance, Hammer Packaging has agreed to a limit on actual VOC emissions from this process of less than 10 tons per year.

The Draft permit includes a proposed RACT variance from Part 228-1.3 for Surface Coating Processes which will require a federally enforceable limit of 10 TPY of emissions of VOC, and conditions under Part 234 for the printers. The Department is required to seek comments and address any significant issues on the Draft permit prior to making a final decision.

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
