Project Description:

The Department has drafted a permit and made a tentative determination to approve this application to re-issue the State Pollutant Discharge Elimination System permit which authorizes existing discharge of 10,400 gpd treated wastewater to Lake Champlain a Class A waterbody from the applicant's facility located at 3461 NYS Route 9, Peru. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the over all proposed project. Refer to this application by application number listed above and SPDES number, NY0255815.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Applicant proposes a 49 lot residential subdivision to include a stormwater basin, emergency access road to Cleveland Avenue, and public trail affecting approximately 1.32 acres of Class 1 Wetland R-14 protected adjacent area, and 0.23 acres of federally-protected wetland. The site is located on the west side of Rt. 9 in the Village of Round Lake, Town of Malta.

SEQR Lead Agency: Round Lake Village Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant has proposed a +/- 12.0 acre expansion of an existing +/- 5.0 acre Life of Mine sand and gravel mine on a +/- 39.3 acre parcel of land on the west side of Gannon Road, approximately 0.5 miles north of the intersection of Gannon Road and County Route 59A. The mine will continue to be operated as a traditional surface opening extraction with mechanical excavation and processing by screening. No material washing or mining below the water table is proposed.
