Project Description:

The Department has received and made a tentative determination to approve an application from Tennessee Gas Pipeline Company (TGP) for the construction of a 30 inch diameter pipeline loop approximately 3.1 miles long between Marks Corners Road and Kidder Road in the Towns of Mina and Sherman in Chautauqua County. The pipeline is part of TGP's Niagara Expansion Project which is a joint project being undertaken with National Fuel Gas Supply Corporation's Northern Access 2015 project. Both projects are subject to permitting under the Federal Energy Regulatory Commission (FERC).

The pipeline route is parallel to the applicant's existing Line 200 and crosses three state regulated wetlands - CY-10, CY-15 and CY-18. Approximately 0.08 acres of wetland and 0.3 acres of regulated adjacent area will be permanently impacted by conversion of one wetland type to another and establishment of a maintenance right of way. Impacts will be mitigated by preservation of wetland area in the head waters of French Creek and approximately 4.9 acres of wetland restoration.

As a tentative determination, the Department is seeking public comment on this application prior to making a final determination on permit issuance.

Project Description:

The Department has made a tentative determination to approve this application for a Solid Waste Management permit for the Buffalo Veterans Administration Medical Center (VAMC) to operate a Regulated Medical Waste autoclave unit capable of treating on average 1,350 pounds per week (app. 70,000 pounds per year) of regulated medical waste. The waste will be generated at the facility and from its "sister" facility, the Batavia VAMC. The waste will be placed in the unit and subjected to high pressure and steam for a period of time sufficient to destroy all pathogens. The waste is then cooled and removed from the unit and then transported to a permitted landfill for disposal. The unit will be located in a newly constructed room within the center's existing building.

As a tentative determination, the Department is seeking public comment prior to making a final determination regarding permit issuance.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a modified Title V Air permit for the addition of one simple-cycle natural gas fueled combustion turbine rated at approximately 7753 horsepower at site conditions and the replacement of an emergency generator at the Concord Compressor Station. The modification is part of National Fuel's Northern Access 2015 project which is being undertaken jointly with Tennessee Gas Pipeline Company's Niagara Expansion Project. Both projects are subject to permitting under the Federal Energy Regulatory Commission (FERC).

The turbine is limited to NOx emission concentrations of 25 parts per million by volume on a dry basis adjusted to 15 percent oxygen. The turbine's potential to emit emission rates were compared to the significant project thresholds for all pertinent contaminants found in Table 6 of 6 NYCRR Part 231-13.6. Since no thresholds were exceeded for this permit modification, Part 231 New Source Review is not applicable.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of up to 281 million gallons per day (MGD) of water for operation of the Somerset Steam Generation Station. Withdrawals are limited to 274 MGD monthly daily average by the facilities SPDES permit. The facility has been in operation since 1984. No changes in current operations are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

STATE ENVIRONMENTAL QUALITY REVIEW (SEQR) DETERMINATION: The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).
