Project Description:

The Department has made a tentative determination to approve this application for a new SPDES permit # NY-0272515 for Anderson Commons, a cluster subdivision of 52 residences and a mixed-use commercial lot. The applicant proposed a subsurface discharge of up to 11,000 gallons per day (gpd) of treated sanitary waste through four community septic disposal system with following outfalls and flow rates: Outfall # 1 - 4,960 gpd; Outfall #2 - 2,880 gpd; Outfall # 3 - 9,60 gpd; Outfall #4 - 2,160 gpd.

The eight (8) single-family individual septic systems are not subject to DEC regulation and so are not part of this application.

The applicant proposes to construct a new water supply well (LIZDA Well #2) with 71 gallon per minute (gpm) capacity as a replacement for an existing well (LIZDA Well #1), which has failed and has been permanently taken out of service by the Village of Harriman Water District. LIZDA Well #2 is proposed within an existing well field and will be connected to the existing municipal water supply system to meet water demands and fire flows. The total amount of taking for the Village water district is 1.2 million gallons per day (MGD). The project is located south of Melody Lane on Pumphouse Road in the Village of Harriman, Orange County.

Article 19 Air State Facility

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue an Air State Facility permit renewal for the Avon Product's cosmetics research and development facility located in Suffern, Rockland County. Emission sources consist of two boilers rated at 21 mmBtu/hr each and one emergency generator. The boilers are fueled primarily by natural gas with No. 2 oil as a backup. Facility emissions for oxides of nitrogen have been capped below major stationary source threshold under a 6 NYCRR Part 201-7 condition. The capping condition incorporates an empirical formula restricting facility wide emissions which is based on fuel consumption for the boilers firing No. 2 fuel or natural gas, as well as the exempt emergency generator firing diesel. The facility is also subject to monitoring and reporting requirements under 6 NYCRR Parts 201, 225 and 227. The Standard Industrial Classification representative of this facility is 8731 - Commercial Physical and Biological Research and 2819 - Industrial Inorganic Chemicals.

Renewal 1

Department initiated renewal for Avon Products. This renewal addresses minor reporting changes, as well as adds mandatory conditions for regulations that have been updated after this permit was first issued. The facility is subject to New Source Performance Standards 40 CFR Part 60 Subpart Dc--Standards of Performance for Small Industrial-Commercial-Institutional Steam Generating Units, however, the more stringent limits of 6 NYCRR 225-1.2 and 227-1.3 supersede those in Subpart Dc. The facility is also subject to 40 CFR 60 Subpart IIII and 40 CFR 63 Subpart JJJJJJ requirements. Renewals expire after ten years, as per 6 NYCRR Part 201-5.2(c).

By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit.

The Department has made a tentative determination to to approve this application for a new State Pollutant Discharge Elimination System (SPDES) Permit for an existing discharge of 25,000 gallons per day of treated sanitary wastewater to the Shawangunk Kill [DEC Waters Index #H-139-13-19, class B(T)] from an existing wastewater treatment plant at the above referenced facility. A new SPDES permit is required because the previous permit has expired.

Changes from the previous permit include addition of a phosphorous limit and a Schedule of Compliance to the draft permit, and an increase to the sample frequency for fecal coliform. SPDES ID Number NY 014 8598. A draft permit is available for inspection and comment at the regional office.
