Public Notice

Amendments Completed on the Final Freshwater Wetlands Maps for Erie County:

Subsequent to the promulgation of the final Freshwater Wetlands Maps for Erie County in 1986, New York State Department of Environmental Conservation (NYS DEC) Staff found inaccuracies affecting Erie County Maps 9, 10, 13 and 14 of 31. Having fully investigated these sites, NYS DEC Staff sent notice of the proposed amendments to the affected landowners and local municipal officials, and published notice in local newspapers and in the ENB. NYS DEC Staff reviewed public comments received and no public hearing was held. Upon review of NYS DEC Staff's findings and recommendations relative to this matter, the NYS DEC Commissioner was satisfied that NYS DEC Staff appropriately responded to all oral and written comments on the proposed amendments, and that NYS DEC Staff's recommendations were consistent with the requirements of the Freshwater Wetlands Act and supported by the record.

The NYS DEC Commissioner ordered that the Erie County Maps be amended to add Class II wetlands LA-18 and LA-19 to Map 9; and to add Class I wetland LA-17 to Maps 9, 10, 13 and 14, effective January 28, 2015. A copy of the final maps will be filed with the office of the clerk of each affected local government and in the NYS DEC Region 9 Office, Buffalo, NY.

Negative Declaration

Chautauqua County - The Town of Busti Town Board, as lead agency, has determined that the proposed Adoption of Local Law #1 of 2015 - Regulating Boat Storage in the LMR District will not have a significant adverse environmental impact. The action involves the amending the Town of Busti Zoning Code to permit the storage and repair of boats and other marine equipment within the Light Manufacturing and Research and Development District, subject to special use permit issued by the Zoning Board of Appeals. The project is located throughout the Town of Busti, New York.

Erie County - The Town of Lancaster, as lead agency, has determined that the proposed Rezone 5354 and 00 Genesee Street from R-1 and RCO to MFR-3 will not have a significant adverse environmental impact. The action involves the rezoning of approximately 27.5 acres of land to MFR-3 to support the development of 76 Senior Town home units. The site is formerly the Harris Hill Golf Center. The project is located 5453 and 00 Genesee Street in the Town of Lancaster, New York.
