Project Description:

The applicant proposes to renew and expand an existing 28.66 acre life of mine facility by 13.7 acres for a new life of mine total of 42.36 acres within a 106.49 acre parcel of land. The project site is located mostly on the applicant's property along with small portions of neighboring properties. The project is located on Blakely Road approximately 2,000 feet east of the intersection with Creek Road in the Town of Genoa immediately north of the Tompkins County line. The mine will continue to operate as a traditional sand and gravel mine. Mining is proposed for below the local water table to a depth of 12 feet below the estimated groundwater level in the southern portion of the mine. This area is proposed as a pond in the reclamation plan. Excavation will be done by mechanical equipment, standard for sand and gravel mining operations. Mining is proposed to remove approximately 3 million cubic yards of aggregate sand and gravel over the estimated 10 year operational life of the mine. Material will be stockpiled or processed with portable screens and crushers. Maximum processing rates for the screen and crushing operations will not exceed 150 tons-per-hour (TPH). Final reclamation will restore the site to a naturally vegetated meadow in addition to a 1.1 acre pond. The reviewed Life-Of-Mine (LOM) area is 42.36 acres.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The New York State Department of Environmental Conservation (DEC) is proposing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0029106), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

The City of Oswego West Side Wastewater Treatment Facility has a design flow of 4.0 mgd and is an activated sludge facility that treats combined sanitary sewage of residential, commercial and two significant industrial users. The facility also accepts occasional sanitary septage from several licensed and permitted haulers. Current treatment includes: grit chamber, screening, primary settling, activated sludge, final settling and disinfection with sodium hypochlorite. Sludge handling units include two centrifuges, dewatering facility which is subsequently hauled to the county landfill. The facility has treated surface discharge via Outfall 001 to Lake Ontario; Outfall 002 to Oswego River; and, Outfall 003 to Lake Ontario, all Class C waters. Outfall 003 serves as a bypass outlet and there has been no discharges from this outfall within the past year.

The following changes to the permit are proposed: Previously non-permitted outfalls (002 & 003) have been listed on the permit. Whole Effluent Toxicity testing requirements for Outfall 001 are listed with the Permit Limits, Levels and Monitoring page. New parameters are being added to the Action Level monitoring requirements. Total Residual Chlorine (TRC) requirements for Outfall 002 consistent with the requirements in the Consent Decree are being added. A schedule of Compliance for TRC is being added. Requirements for Combined Sewer Overflow Abatement program has been revised. Mercury Minimization Plan is being added. Stormwater Pollution Prevention Plan is being added. The Monitoring Locations page has been updated. General Requirements have been added. Pages and forms throughout the permit have been updated.

This project is subject to the Department's Environmental Justice Policy and an enhanced public participation plan has been prepared and accepted as a component of application completeness. Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 610,000 gallons per day (GPD) of water for aggregate washing operations at the Constantuia Center mine. The Facility has been in operation since 1983. No changes in current operations are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

STATE ENVIRONMENTAL QUALITY REVIEW (SEQR) DETERMINATION: The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).
