Project Description:

The Department has prepared a draft permit and made a tentative determination to renew the air state facility permit for the operation of this wood pellet manufacturing facility. This permit renewal incorporates changes to the facility's air pollution control equipment and updates to several applicable regulations. The facility has replaced its existing cyclones with four smaller units in order to better ensure process safety. This permit renewal incorporates new monitoring requirements to ensure that the smaller cyclones are operated in compliance with all applicable requirements. In addition, this permit renewal will maintain Deposit Wood Pellet LLC's existing caps on their potential to emit carbon monoxide, particulate matter, and oxides of nitrogen in order to avoid the requirement to obtain a Title V facility permit. The facility will conduct periodic monitoring activities in order to demonstrate compliance with these emissions caps.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes to conduct an ecological restoration of the stream and floodplain corridor along Sands Creek to improve channel stability, water quality, and aquatic habitat. The project includes berm removal, installation of wood structures, log toe, log sill, log jams, floodplain roughening structures, and bar buddies. The project has a proposed limit of disturbance that will encompass approximately 6 acres. Applicant will seek Stormwater SPDES permit coverage. The northern limit of the project is approximately 1,000 feet south of the Sands Creek Road and Dry Brook Road intersection, and the southern limit is approximately 3,800 feet south of same intersection.

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
