Project Description:

Dutchess County Department of Public Works proposes to rehabilitate Bridge E-9 which carries Palen Road (CR-31) over Fishkill Creek in East Fishkill, NY. Rehabilitation activities will be partially located within Freshwater Wetland HJ-77 (Class II) and its regulated 100 foot adjacent area and will require a Article 24 permit. In addition, the construction of the new retaining wall and drainage pipe headwall will cause the excavation and fill 30 CY of Fishkill Creek [Water Index No. H-95, Class C(T)] and will require an Article 15 permit.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The applicant proposes new emission sources requiring an Air State Facility permit which will replace the facility currently authorized under the Title V facility permit 3-3924-00178/00009.

Rockland Psychiatric Center is a State-owned hospital serving Rockland, Westchester, Orange, Sullivan, Putnam, Dutchess and Ulster counties. A new centralized utility plant (CUP) will provide steam for the heating and cooling of eleven of the buildings formerly heated by the old plant. Numerous other buildings on the campus have been vacated, sold or leased to other entities, or are slated to be demolished. The new CUP will therefore serve a much smaller consolidated campus.

The new CUP building will house three boilers, each with a maximum heat capacity of 24.9 mmBtu/hr. These boilers are designed to combust natural gas and No. 2 fuel oil to produce steam for space heating and cooling. Combustion of No. 6 fuel oil will cease with the decommissioning of the existing Title V plant. The CUP will also house two new, diesel-powered generators rated at 100 kW and 2000 kW at maximum output. A third new 2000 kW unit will be constructed in a shed near Building 39. The new generators are additional to the eight exempt generators located on-site, some of which are slated to be decommissioned in the near future. The facility is capped below 25 tons per year of NOx. As a minor source, the facility is not subject to the Title V permitting requirements of 6 NYCRR Part 201-6.

The facility is subject to monitoring, reporting and recordkeeping requirements under 6 NYCRR Part 201, 6 NYCRR Part 225 and 6 NYCRR Part 227. The facility is also subject to 40 CFR 60 Subpart IIII and 40 CFR 63 Subpart JJJJJJ federal requirements. Air state facility permits expire after ten years, as per 6 NYCRR Part 201-5.2(c).

The Standard Industrial Classification representative of this facility is 8063 - Psychiatric Hospitals.

A draft permit has been prepared and is available for review in the DEC office in New Paltz.

This project is subject to the Department's Environmental Justice Policy and an enhanced public participation plan has been prepared and accepted as a component of application completeness. State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: NYS Dormitory Authority

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. The department must consult further with OPRHP before making a final decision regarding the issuance of the permit.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
