In order to ensure the public has adequate opportunity to assist NYS DEC in its review, the public comment period has been extended to Friday, February 27, 2015.

State Pollutant Discharge Elimination System (SPDES) General Permit for Stormwater Discharges from Construction Activity Permit No. GP-0-15-002.

The New York State Department of Environmental Conservation (NYS DEC) has renewed the SPDES General Permit for Stormwater Discharges from Construction Activity, as GP-0-15-002.

General Permit GP-0-15-002 will be effective from January 29, 2015 to January 28, 2020, and it is a replacement for General Permit GP-0-10-001 which expires on January 28, 2015. Exclusion criteria are contained in the permit that identify when use of the General Permit is not permissible.

A notice of draft general permit was previously published in the ENB on July 30, 2014. This project (general permit renewal) is an Unlisted Action under the State Environmental Quality Review Act. A Negative Declaration is on file for SPDES General Permit for Construction GP-0-15-002. A coordinated review was not performed in accordance with 6NYCRR Part 617.6(b)(4).

NYS DEC has also updated the New York State Stormwater Management Design Manual (Design Manual) to reflect changes made to the General Permit.

Copies of the final General Permit, Fact Sheet, Responsiveness Summary, and Design Manual will be available on NYS DEC's website beginning January 14, 2015. This general permit authorizes discharges of stormwater from construction activities that are required to obtain coverage in accordance with the Environmental Conservation Law.

All owners or operators with coverage under GP-0-10-001, as of the effective date of GP-0-15-002, will be authorized to discharge in accordance with GP-0-15-002, unless otherwise notified by NYS DEC. Applicants seeking new authorizations to discharge will be required to file a Notice of Intent to obtain such authorization.

The NYS DEC reserves the right to require any applicant seeking or maintaining coverage under GP-0-15-002 to apply for an individual SPDES permit.

Final Amendment No. 1 to the Drinking Water State Revolving Fund Federal Fiscal Year (FFY) 2015 Intended Use Plan

FFY 2015 Annual List Project Amendments:

Draft Amendment #1 to the Drinking Water State Revolving Fund Intended Use Plan issued October 1, 2014 was published in the December 17, 2014 issue of the Environmental Notice Bulletin. The comment period for the Draft Amendment #1 closed on December 31, 2014. The New York State Department of Health (NYS DOH) received no public comments pertaining to this amendment. Therefore, the amendment to the Drinking Water State Revolving Fund Intended Use Plan is final as shown below:

Beaver Dam Lake Water Corporation, Orange County DWSRF#15072 - The project cost listed in the Intended Use Plan is amended to $1,115,000 to accurately reflect the remaining funds required from the DWSRF program to provide for the project's DWSRF long term financing. The cost increase is due to the incorporation of additional water main replacement work into the project and it will be provided with a term of up to 30 years at 0% interest.

Perrysburg (V), Cattaraugus County DWSRF#18022 - The Intended Use Plan Project Annual List is revised to reflect the hardship designation of "H" in the score column for this project. The project is a cost overrun for the hardship designated project DWSRF#17192. The project is eligible for a financing term of up to 30 years at 0% interest.

NYS DOH has determined that the project amendments are necessary, reasonable, and in the interest of protecting public health. The project amendment will not adversely affect any project on the IUP Project Annual List above the subsidized funding line. Except for the above noted project amendments, there are no other changes to the IUP as a result of this amendment.

Final Amendment No. 1 to the FFY 2015 CWSRF Intended Use Plan

Modification of the Financial Application Deadline and Revisions to the Financial Hardship Policy and Category C of the Annual Project Priority List

The New York State Environmental Facilities Corporation (NYS EFC) and the New York State Department of Environmental Conservation (NYS DEC) announce that the Federal Fiscal Year (FFY) 2015 Intended Use Plan (IUP) for the Clean Water State Revolving Fund (CWSRF), dated November 2014, has been amended.

This Final Amendment No. 1 to the Clean Water State Revolving Fund (CWSRF) Intended Use Plan (IUP) for Federal Fiscal Year (FFY) 2015 includes information regarding a modification to the financial application deadline as well as revisions to both the CWSRF Financial Hardship Policy and Category C of the Annual Project Priority List.

The Final Amendment No. 1 will be available on the NYS EFC website at: www.efc.ny.gov.
