Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a renewal of the Air Title V Permit for a gasoline/distillate loading terminal located at 625 Elk Street in the City of Buffalo. The terminal consists of six storage tanks of different volumes containing gasoline/ethanol/distillate along with several other storage tanks containing gasoline additives and heating oil/diesel. One loading rack with three bays is also located on-site. Loading is controlled with a vapor recovery unit.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a modified Air State Facility permit for Ford Motor Buffalo Stamping Plant. This permit modification allows for the installation and operation of a scrap aluminum conveyance system for off-site recycling which is identical to one installed in 2009 under the first modification to this permit. The total system now consists of six (6) press lines, six (6) shredders, metal duct work, and two cyclone filters which separate the aluminum from the air stream. The system is subject to the particulate emission limitations found in 6NYCRR Part 212.6(a) and 212.4(c). The facility has accepted a NOx emission cap of less than 95 tons per year and a SO2 emission cap of less than 95 tons per year and is therefore not subject to permitting as a Title V major facility per 6 NYCRR Subpart 201-6. The Department is seeking public comment prior to making a final decision on permit issuance. A draft permit is available for review.

A Structural-Archaeological Assessment Form has been completed. The proposed activity will not impact on registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has received and made a tentative determination to approve an application for a Part 360 Solid Waste Management permit for the above referenced facility. The applicant proposes to consolidate or aggregate loads of used oil, non-hazardous regulated liquids & solids, and containerized asbestos for the purposes of transportation off-site to other properly permitted treatment, storage or disposal facilities for final treatment, recycling or disposal as necessary. A existing building on site will be upgraded to house the proposed facility. As a tentative determination, the Department is seeking public comment on the proposed project prior to making a final decision on permit issuance.
